NEED ADVICE ABOUT PERMANENT RESIDENT APPLICATION

Hello Everyone,

First of all I would like to thank again members of this forum for helping me along my applications journey ( family permit, residence card).

My wife (EEA) would like to apply for the Permanent Residence. She came to the UK since 2012 as a worker.
On February 2013 she got maternity leave for 12months (9 Mon with maternity allowances and 3 unpaid).
Then she started working again since February 2013 until now.
She so far got 5 P60 with her ( 2014; 2015; 2016; 2017; and 2018).

So my questions are:
1_ would she be able to apply with only these 5 P60?
2_ Does she also need to send the maternity allowances letter and the maternity certificate for the year 2013?3_ can we apply together since I have join her to the UK since November 2013 even though I got 6 months left on my residence card?

Yes ,five year period Feb 2013 to Feb 2018, there should also be a P60 for Feb/March 2013.

No, you must complete the five years as spouse of EU sponsor, there is no early application..

Like Alterhase said - she could apply from Feb 2013 with the 5P60s + either 2 pay slips for Feb and March 2013, or the 6th P60 relative to 2012-2013.

She could also apply since the date she started working in 2012 and include her maternity leave and the 3 unpaid months - provided she was employed during that time. If she wants to include this period and start her 5-year QP from 2012, she should include her maternity letters/etc. If she has them, she can also include her P60s for 2012 and 2013 (or pay-slips, if she doesn't have P60s).

Given 5 years have passed since November 2013, I think you can apply together - regardless whether your Residence Card still has 6 months on it. Not sure why Alterhase thinks not.

NikiGio, she actually doesn't have P60 for 2012 and 2013;
but she does have Pay-slips for 2012 (August,September,October,November and December)
And for 2013 she haven't got Pay-slips and P60 .the only thing she got is the Maternity Allowance letter and the Maternity Certificate. She delivered on February 2013 ,so she's been on maternity leave for the year 2013 and deceiving maternity allowance Paid.

So she should state that she's applying for PR from August 2012 - and send the pay slips for 2012, the maternity allowance letter and the maternity certificate for 2013. Plus the P60s for 2014, 2015, 2016, 2017 and 2018. Also pay slips for April -
November 2018 (included).
If you apply together, make sure you make it clear in a covering letter that her 5-year QP is August 2012-August 2017, and that yours is November 2013-November 2018.

I have been filling the Application Form online, and i have some questions .

On the Activities section, we have filled my wife work details from 2012 until now.
And there's another question asking if she has been self-employed?
my wife has been self-employed not a long time and employed at the same time.

so since we are applying as a worker, should we put down her self-employment details or just leave it blank?

Given she's applying using her P60s as evidence of being an employed worker, she should leave the self-employment section blank.
Maybe add a covering letter to explain that she's been both employed and self-employed, but given she's applying based on her status as a worker, the fact she was also self-employed is irrelevant to the application and therefore no details are being given.

I do have another question about my Kids, we decided to include them in the application.

My boys (twins) were born in the UK in 2013. Since then they have been leaving in this country. They are now nearly 6 years old.

So my question is: which supporting documents do we need to include in our application apart from their birth certificates to support their application?

To understand which documents you need to include - have a look at the EEA (PR) application form itself, at the Guidance Notes and at the HO's Free Movement guide for direct family members (your children) and for Qualified Persons (your wife):

Also do a search for posts in the forum related to evidence for PR for children.

Remember that any documents not in English need to be translated by a certified translator.
