1. The jobs have to be created AFTER your extension was approved, so after 13/4/18. You can take into account job created 12 months before application date ONLY if you are applying before 13/4/19. (so if you are applying on 28/3/19, you can use jobs from 28/3/18)Sam2829 wrote: ↑Sat Dec 29, 2018 2:50 amAll dear members your feedback will
Be much appreciated. My 5 years as tier 1 entrepreneur will complete on 03 April 2019. I have fews things to clear before apply.
1. I have applied for extension on 27/03/2017 HO took around 13 months and my visa got approved in april date on BRP 13/04/ 2018. I am planning to apply my ILR on 28/03/2019 around a week before qualifying date. My first question do I have to send 2 full time jobs proof from march 2017 ( 2 years ) or only last 12 months ?.
2. If I send only last 12 months then will my employees hours during visa processing time will get considered to claim points ?
3. I have 1 job since 06/08/2017 still continue and 2nd job from 06/03/2018. Will these 2 covers the requirements?
4. Do I have to apply my wife and 2 kids ILR as well with me as well as they are my Tier 1 entrepreneur PBS dependents but their visas are valid till 13/04/2020 or I am ok If I only apply my ILR due to restricted funds for now? Many thanks
Of course you can apply alone without your dependants since they still have valid visas till 2020. You can then apply for them once yours has been sorted.Sam2829 wrote: ↑Sat Dec 29, 2018 2:50 amAll dear members your feedback will

If there is less than 12 months gap between your ILR date and extension granted date; then you can claim for 12 months immediately before ILR application date.Sam2829 wrote: ↑Sun Dec 30, 2018 7:19 amDear Marcnath 1. so it means I only need to send last 12 months employment record and pyslips, FPS etc ? 2. Does the date reflect ur visa issue date e.g 03/04/14
Or 28 days before the visa issue date?

Why not 01/04/19? Or if your initial visa was issued on 03/04/14 minus 28 days=06/03/19
My first question do I have to send 2 full time jobs proof from march 2017 ( 2 years ) or only last 12 months ?
Last 12 months preceding date of ILR application
2. If I send only last 12 months then will my employees hours during visa processing time will get considered to claim points ?
Yes. Since you’ve received ur ext late but qualify for ILR.
3. I have 1 job since 06/08/2017 still continue and 2nd job from 06/03/2018. Will these 2 covers the requirements?
1st April 18- 31st March 19- payslips n RTI FPS
Or
Job 2 conpletes 52 weeks= 06/03/18- 05/03/19.
In that case- 1st March 18- 31st March 19 Payslips n RTI FPS

For example if you apply on 1st Dec 2018; you can claim from 1st Dec 2017. Yes you would need to send 12 months FPS.
The employee’s start date is no longer a requirement. The law changed in Jan 2018. So if your employee started earlier than the period you are claiming for there is no need for old FPS. You will declare the start date of employee on the online form.
Yes you can apply your own visa first. You can apply dependensts visa upto as long as they have valid leave. In case your visa is approved and then you apply for dependets you can also opt for super priority 24 hours option incase of Tier 1 dependents.

What’s the bank statement cut off date got to do with it? You need one bank statement or a bank letter which can be within 3 months of application date...
My first question do I have to send 2 full time jobs proof from march 2017 ( 2 years ) or only last 12 months ?
Last 12 months preceding date of ILR application (So it means ILR also required only 2 full time Jobs from last 12 months)?
Yes. Have you even read the guidance? 52wksx2 or 12x2
Go 12 months back from date of ILR application
2. If I send only last 12 months then will my employees hours during visa processing time will get considered to claim points ?
Yes. Since you’ve received ur ext late but qualify for ILR. ( please elaborate).
Im not speaking french.. it’s simple. Re read guidelines.
If you qualify for ILR less than 12 months from the date of extension then you may use the immediate preceding 12 month period which shall include period during visa processing time.. .
In that case- 1st March 18- 31st March 19 Payslips n RTI FPS ( but I can't send from 1st march 2018 as job only started on 06/03/2018 there will be a 5 week gap 52 weeks are not complete) ?
I can’t believe you don’t get it.
You do know that you can generate a payslip n RTIFPS before the end of the month right?
How is there a 5 week gap? Ur sending in March 2018 RTI n payslip- when did ur employee start? Your sending March 2019 payslip n RTI ur employee completes 52 weeks on 05/03/19. You can easily apply on 06/03/19
apply 28 days within their 5th year anniversary qualify date.

Sorry My mistake 5 days not week. Let me please clear this point as it is the only point confusing me right now.
Need to complete 12 months or 52 weeks right..
Job Start Date: 06/03/2018
FPS shows start date 06/03/2018
Now my payslip for feb 2019 will show hours worked till 28/02/2019.
So it means working weeks are total 51 missing one week. and I am on monthly payroll hours cut off date is last day of the month.

So I am not sure I get what your doubt is about.
If the job started on 6/3/18, you will need to submit the March 2019 documents to provide evidence of 12 months. ( many thanks I am clear now )
In your initial post, you mentioned you plan to apply 28/3/19, so there is no problem for you to submit March 2019 documents - what is your concern here ?
Many thanksaman90 wrote: ↑Mon Dec 31, 2018 12:33 pmIf the job started on 6/3/18, you will need to submit the March 2019 documents.
Don’t worry! You have a lot on your plate and this is just the beginning. You shall be overwhelmed by a number of things in the future
Good thing is you’ve started in time!
I would not waste a single day from the date One qualifies for ILR as it’s a long waiting process to citizenship and literally puts life on hold.
Business bank statement-
Use the one generated In February 2019.
Or get a BB letter of confirmation near to the date of your application.
Don’t let this stop you from applying from the date you qualify.
Your situation is perfect to apply!
Ask ur accountant or payroll manager to:
Issue a March 2019 payslip and submit RTI FPS for March 2019 early.
You dont need to wait for end of March 19 to apply.
Whenever you apply is ur prerogative.
This is all you need:
March 2018 to March 2019: Payslips and RTI FPS for both employees.
Use timeanddate calculator for piece of mind.
