Wife's Citizenship Application

Hi,

I am a British Citizen since Oct'17 and would like to check if my wife who came to this country in Feb'14 as PBS dependent, applying for her ILR next week, will she be eligible to apply for naturalisation straight after her successful ILR?

She has no more than 30 days/yr absence since she landed first time, we have been living together throughout. She has her LIUK pass certificate, English Lang pass certificate, she is working as lecturer, has no FPN's or CCJ's against her name, never defaulted on any payments, etc.

Yes she can if she meets the 3 year residence requirement to apply as spouse of BC, including the physical presence 3 years ago mandatory requirement.

What exactly is the 3 years residence requirements?

is it:
- have lived in the UK for at least 3 years before the date of your application
- spent no more than 270 days outside the UK during those 3 years
- spent no more than 90 days outside the UK in the last 12 months
- been granted indefinite leave to remain or permanent residence
- not broken any immigration laws while in the UK

Or there is more to it?

The day she applies for BC, she must had been in UK on exact date 3 years ago. For example if she applies on 10 Jan 2019, she should had been in UK on 10 Jan 2016.

Hi CR001,

Final check before we apply for my wife's citizenship application, below are the details:

It will be based on being partner of British citizen, and have lived in the UK for at least 3 years before the date of your application. I received my citizenship in Oct'17.

- She received her ILR on 11/01/19
- spent no more than 270 days outside the UK during last 3 years
- spent no more than 90 days outside the UK in the last 12 months
- been granted indefinite leave to remain or permanent residence
- not broken any immigration laws while in the UK
- She was physically present in the UK exactly 3 years ago

Anything that you think we have missed that might be a show stopper? or we are good to progress?
