Amz wrote: ↑Mon Jan 07, 2019 4:41 pmHi All
My 5 Years are completing on 4th April 2019 and I have a few questions if someone can help me sort them out.
1. My employment would be 24 months ( mix and match with 3 employees) from March 2018 - March 2019 ( It is my understanding that If the last grant of leave was less than 12 months of ILR than last 12 months will be counted to employment instead of 12 months of extension period i.e. My extension was granted in June 2018 valid up-to June 2020 and My ILR is Due in April 2019 so I can count employment from March 2018 if I am applying in March 2019. So as per law I can apply 28 days before ILR is due, What I would like to know is that what about the employment working hours for the Month of March 2019 If I apply on 15th March 2019, I wouldn't have my salary slips etc for the Month of March, how would Home Office cater for that to make up 24 months of full time employment.
Your understanding is correct. However, you would need to send the FPS for March 2019 also. You can generate FPS early in the month, not necessarily at the end of the month. Note that you can claim immediately 12 months before the date of ILR
2. My Wife came to UK as my dependant in February 2015 so her 5 years would be completed in February 2020. If I am granted my ILR than what becomes of her visa, since she was dependant on my Tier 1 Route and after my ILR my Tier 1 Leave to remain would not be valid anymore, how does that work for her ?
Your wife can continue as PBS dependent visa till she will qualify for her own ILR
3. My son was Born in April 2018 UK and he has his visa as dependant until June 2020 same as mine, Do I apply for his ILR as well along-with my visa or not ?
Your son can continue as it is. You can register your son as British Citizen once you have your own ILR
4. Do we need to send Personal bank statement for Maintenance and Business Bank statements along-with Visa application ? I have read mixed answers on this forum so I am not sure.
Business bank statement or bank letter is mandatory
Personal bank statements are optional
Prompt response would be much appreciated.
Regards

I have 2 urgent questions to ask If someone can help me.
I received the letter of initial Tier 1 visa approval dated: 03-04-2014, I received the BRP which stated place and Date of Issue, UK 24-04-2014 and valid until 03-04-2017
My Questions are:
1. I am allowed to apply 28 days before the completion of 5 years, so which date do I need to take as a reference ? is it:
A. 3rd April 2019 (completion of 5 years in respect to 3rd April 2014 when my Visa approval letter was dated) which would allow me to apply as early as 7th March 2019 considering I can apply 28 days earlier
B. 24th April 2019 (completion of 5 Years in respect to 24th April 2014 which is the date of issue stated on my Initial BRP) which would allow me to apply as early as 28th March 2019 considering I can apply 28 days earlier
You will complete 5 years from date of approval so you can apply 28 days before 3/4/14. see link
indefinite-leave-to-remain/ilr-5-year-r ... 46694.html
My 2nd Questions is:
If I am applying in March 2019 (7th March) does that mean that my past 12 months would be counted as below for employment if total number of hours spread between 3 employees are a minimum of (30 Hours X 52 Weeks = 3120 Hours combined for 2 full time employment
March 2018, April 2018, May 2018, June 2018, July 2018, August 2018, September 2018, October 2018, November 2018, December 2018, January 2019, February 2019
Do I have to include March 2019 as well or not If I am applying on 8th March 2019 ?
If you apply on 8th March you can claim job creation for 12 months “immediately” before the date of application i.e. 8th March 2018 - 7th March 2019. In that case you have to send FPS for March 2018 - March 2019. You will have to generate an early FPS for March 2019
Regards
You only need evidence for the period you are claiming points for regardless of when the employee started. The start date on FPS law has changed and no more required. So you only need March 18 - March 19 i.e. the period of claim.Amz wrote: ↑Wed Feb 13, 2019 11:46 amThanks a lot Tier1147
Another Question.
I have 3 employees:
Employee A: Started 3rd July 2017
Employee B: Started 1st August 2018
Employee C: Started 3rd September 2018
so from March 2018 - March 2019 it will be 12 months for employee A , 8 months for Employee B and 7 Months for Employee C , in total 27 months of employment. (all with a minimum contractual agreement of 30 hours per week)
What i would like to know is that do i send the salary slips of Employee A for period between July 2017 - March 2018 (against which i am not claiming job creation time) and also in case i do need to send, what about the RTI ?
Do i send RTI from July 2017 - March 2019 or only from March 2018 - March 2019 (as Employee A start date would be on July 2017 RTI
**** Please keep in mind that I am applying under the Immigration Clause:
If my latest grant of Leave is less than 12 months for the completion of 5 years then I can use the last 12 months for claiming points.
That’s a weird question.. what difference does it make where it’s posted as long as it has ur business address and other necessary details!Amz wrote: ↑Tue Mar 05, 2019 2:53 pmI would also like to ask something else. My Business banking is with Santander Bank and I requested a letter from the bank stating the details of my business and current status of my business account i.e. its an active account etc etc.
The bank tells me they have changed the procedure now and since the request is for myself, the letter will be posted at my home address, although the letter will have my business name, business address and account details on it, but it will be posted to my personal home address rather than business address.
Do you think that would be a problem ?
Regards
Approval date: 03/04/14

If you are relying on transitional arragements, you should list your employees as separate jobs as scenerio A. Ignore the online form as it says jobs should exist for 12 months each but it does not apply to you ONLY if you apply before 6th April 2019.
No you are not. If you travel out of the UK, your application will be considered withdrawn.I suppose since i have my passport and BRP with me and my BRP doesnt run out until July 2020, I am good to travel while my application is in process.
