Tier 5 (Youth Mobility) 'switch' to Tier 2 (General) Visa

Hi guys,

I am from Hong Kong and my Tier 5 visa is due to expire 3rd Oct 2019. My current employer (I work full time in digital marketing) is willing to sponsor me. I know you can't technically 'switch' to a Tier 2 visa so I am planning to return home to apply, however, there are a few things I can't quite wrap my head around.

- Will my chances of getting Tier 2 be affected because I was already issued a Tier 5 visa
- Can I apply while my Tier 5 visa is still valid (I'm planning to go home around June to apply)
- I would definitely need a restricted COS, just need a confirmation!
- Does my company have to terminate my current contract first before 're-hiring' me?
- Would it be a problem that I am working within the company while the Resident Labour Market Test is being held
