I want to further clarify all depends on the motive. I want to ask if we want to live in any Schengen country. Will it be necessary for my husband to go and get a job in that Schengen country first and then apply for my visa as a family member of an EU citizen.
You face the same issue in any other EU Country. Your husband’s EU Status! So if the UK leaves the Union by end of March then Freedom of movement for British Citizens and their family as we know it MAY or HIGHLY likely cease or change. Either way nobody knows for certain what the new status quo will be.
So the problem is your husband’s EU Status after Brexit and not the other way around.
The process of applying under Freedom of Movement Treaty is in principle the same in ALL EU countries. It only requires one of the persons to be a EU member in order to exercise such rights.
Schengen is EU’s answer to a standardised visa system that allows other Non-EU Visa requiring countries to enter Europe for general visiting purposes but NOT settlement.
As I said we don’t know Britain’s future relationship with EU and vice versa. However one possible option in the future would be:
If your spouse is a highly skilled worker then he should be able to secure a Work Permit in which case, there’s already a well established system of bringing family with them. This option would be of benefit if the new EU-UK relationship requires British nationals to apply for work permits in Europe after they are officially out. I suppose none of us hold a crystal ball but is worth bearing this option in mind.
Has your husband consulted a reputable Immigration lawyer in the UK to see what options are available to you? From your comments it sounds that you have children if I’m not mistaken?
