Wife's eligibility for ILR

Hello all,

My wife is planning to apply for her ILR this month. I received my ILR January last year. We've been using 30 hours free childcare since September 2018. We were just going to apply for her ILR and just noticed that it mentions that neither I or my partner should not be using public funds:

"When you apply for settlement, you and your partner must:

be living together in your own accommodation
not be using public funds"

The childcare account is based on my ILR status and not hers.

1. Does that mean that if we apply for her ILR application, she might get rejected?
2. Can we cancel the 30 hours free childcare and then apply for her ILR?

As it is under your name she didn't use public funds. Has no effect on her ILR
