Concerns:- Please note that they have taken the NET INCOME AFTER TAX and NOT THE GROSS INCOME BEFORE TAX for assessing me on this parameter. This is contradicting the statement as per the Tier-1 general Policy Guide, under the section of Assessment of Previous Earnings, Paragraph 87, first line, which confirms that for applicant’s in salaried employment, gross salary before tax will be assessed.

However, in my case, as per the Entry Clearance Officer’s decision, the ECO has commented that my income has been recalculated as per the NET INCOME. Thus, he has arrived to a figure of INR 3XXXXX, which is post Tax as per my payslips, as against INR 4XXXX claimed by myself which is Gross Salary before Tax. This now leaves me with just 20 points instead of 30 points.

Also, as per the ECO’s comment in the previous earnings, he has mentioned that I have claimed 40 points for my previous earnings, whereas I have just claimed 30. Please note that as INR 4xxxxx when converted and uplifted to the UK standards, works out to GBP 3xxxxx, it actually falls under the 30 point scale as it is within the range of £29,000 - £31,999. Hence I had claimed 30 points and not 40 points

Hence, I believe I should be getting 30 full points to equal this section to a total of 75 points.

4) UK Experience
Points awarded are 05 ----- No comments----- Accepted

5) English Language
Points awarded are 10 ----- No Comments ----- Accepted

6) Maintenance
I believe that my Post Office Savings of INR 300,000 has been missed out for evaluation. These funds have been lying with the Postal Savings Department, which is an Indian Government Body, since 19th August 2003. There have been no debits till date (05th June 2008). I have also equipped the British High Commission with the original letter from the Government to that extent.

Hence, I taking this INR 300,000 into consideration, which is equal to GBP 3529 approximately (INR 300,000 / 85, where in 1 GBP has been assumed to be equal to 85 Indian Rupees), I believe that I do have sufficient funds to meet my maintenance requirements in the UK.


All said and done, please also note the following:

The date of refusal of entry clearance that is mentioned in the letter is the 9th of May 2008.
However, I submitted my application only on the 22nd of May 2008 at the VFS office in Ahmedabad

i would really appreciate if anyone could throw some light on it and advice me if its ok to go for an admin review and what are the chances??

Jaan4nav,

Regarding your balance in Post Office for maintainece funds doesnt qualify.

As per my understanding of guidance,

One should have X amount available everytime through out the previous 3 months and these funds should be accessible.

Deposits in Post Office/Bank FDs are not accessible anytime.. To get these funds one needs time to break FD/Deposit.

Wherever you have fund in what ever account, that money should be accessible all times plus there should be inflow and outflow of money in that account.

When I say X amount available through out means say your bank statemnet shows withdrawal in morning and your balance goes low then in same date evening deposits are show to meet the balance.. This also disqualifies.

Just think like a bushman when you are reading guidance...

Regarding your earnings, I wasnt able to understand the issue.

Hey All,

Here are my details so that you can add them in the list:

Type of application : WP to Tier 1 (application within the UK - 90 points + 20 english and funds)
Application Sent : 24/4/2008 (It got rejected right away as payment could not be processed. Although they said transaction denied, the credit card company said there was no record of denial, and everything was normal... who knows... so sent it back on 28/04/08 with postal order)
Application Received: 29/04/08
Payment taken : 29/04/2008
Ref no dated : 24/04/08 (even though I sent it on 28/04/08 again the letter is dated back to 24/04/08. I think they used the same reference number of first intent)
Decision: Waiting (Called them on Tuesday last week and a lady said it was in the final stages, and I should hear from them this week... however I haven't!)

Dinesh if you sent yours to HO on April 29th then this gives the rest of us hope. I sent mine on the 29th April so hopefully I will get something soon.

1. Mariage Certificate (original)
2. Bank statement showing you have been maintainin more than certain amout of fund over last 3 months in addition to your own maintence fund of £800.

**The last statment should not be more than one month old from your date of application.
** If you are applying before 29th June, then just show your last month statement (should not be more than one month old from application date)
** The minimum fund requirement depends on how long you are in UK - if you (along with dependant) stayed in UK for longer than 12 months, then per dependant, you must have £533. If you stayed in UK lesser than 12 months, then you must have £1600 per dependant. This amount must be in addition to your own fund of £800.

You need to fill up a separate form for your dependant. Please go through the dependant guidance of tier-1 in BIA site.

Theoritically, it's fine as it's within 30 days limit. But for peace of mind, just walk upto your bank and ask for an uptodate statement printed in bank stationery and get it stamped and signed by anyone in the branch.

Like, my bank is HSBC and they usually give it, if you request. I would think most of banks in UK wud do so.

Plz dont give wrong information, if you are not clear about it.
The required fund criteria before 29 June is per family £1600 (Spouse+Kids) and £800 for main applicants.

If the Tier 1 (General) - highly skilled worker main applicant is outside the United Kingdom or has been in the United Kingdom for less than 12 months, the family member must show that either;

the main applicant or (in the case of children) their other parent is legally present in the United Kingdom; and
the main applicant has at least £1,600 to support the family member as well as the funds they need to support themselves.

I just called HO. They are not giving updates over the phone anymore. Especially if a lady answers the phone.

So it is a waste of time to call them. Trust me.

I was just hoping to atleast hear something. I guess that it is a waiting game.

Very frustrating but keep the faith.

Same here guys, possibly same woman! but i managed to ask about my urgent fax, which she looked and said yes received and treated urgently, so it's a waste of time i agree...
We r trying to work out how they treat our application, in summary it's all a matter of luck to be honest and forget about straightforward cases and whatever. my case WP to tier 1: age: 10, Earnings : 45 (UK) English:10 maintenance (more than 33K in bank) Bsc (30) UK experience (5) anyways all of them i get 110, i applied on the 28th of april still nothing, ain't that straightforward enough for them?! i'll leave u to judge.
last thursday "documents ready to be sent and i was given the tracking number" friday "still under consideration normal time is 10weeks" today they can't give details anymore.
So yes keep the hope if u still have any:)

I really didn't understand what wrong information I had given. I wrote £1600 per dependant + £800 for self if stayed less than 12 months in UK. You are saying the same. I wrote additionally, the fund requirement as £533 per dependant + £800 for self if stayed in UK longer than 12 months.

So what wrong information, I gave, I'm not sure.

I would say your application seems very straightforward.

I applied from the 29th April with HSMP approval letter which means the only criteria left for HO to check was maintenance section of form.

Why does it take so long, especially for those who have HSMP letter and those who applied in late April.

What are they doing at HO? Honestly. They really need to get a move on and do their jobs properly.

Don't they realise people need their docs to travel or as ID.

They are just dragging this thing out unnecessarily. Waste of time.

Anyways. Trying to keep hope alive.

I am doing my best but i need to leave end of this month, and what is frustrating is that they give different answers each time and most of the time wrong information whether positive or negative. They say 10 weeks or 50 days but do they count the tea break and the coffee break too? i don't think so. Anyways as i said if ur application will fall in the hands of a flexible caseworker (sorry girls u r not flexible enough :) ) u'll be alright if not the date of ur application will suffer from PMS symptoms too! and u need to wait, and when u call, u will feel like a highly skilled goat asking for herbs :) one true feeling is that u can wish to stick ur head through the phone and have a look at the screen urself, and sometime on ur way out bite his/her nose out :)
