FLR (FP) on 10 years lawful residence private life Route

Dear Admin can you please guide me if i can apply on flr (fp) 10 years private route if i have spent 12 years lawfully in UK. Currently my wife is living with me for more than 7 years, can she apply along with me. We have no kids.

History.

Came in UK April 2006
Completed 10 years lawfully without any break in April 2016. Still had valid leave untill June 2016.
Applied ILR on tier 1 point based system in june 2016 rather than applying on long residence.
ILR refused in Feb 2018 , i challanged the decision through JR but recently permsiion was refused,

Can i apply flr fp on private life 10 year route ? On the basis that i have already spent my 10 years lawfully from April 2006 to April 2016.

Can i claim(ILR long residence) my past 10 years lawfull residence which i built in UK from April 2006 to April 2016, as long residence guidance clearly states that if you have spent your 10 years lawful residence you can claim it on later stage as well if you leave the country and come back on any other visa you can claim your 10 years.

On which tier 1 route u applied ILR?
Why your ILR is refused?
If it refused on the basis of deception than any further application will be refused automatically.
To qualify for flr fp 10 year route u need to full fill any 1 of the 4 criteria.
1. A child is under 18 and who spent 7 years in the UK and it is not reasonable for the child to go back.
2. Your age between 18 to 25 and u spend half of your life in the UK.
3. U spend 20 years in the UK.
4. U spend less than 20 years in the UK and no ties back home what so ever.

Everyone falls in 4th point but impossible to get flr fp visa on this point.

without any child involved very hard for u to get flr fp visa.

Yes it was refused under 322(5) tax difference.
Can i claim human rights article 8 on private life ? Under flr fp or can i apply through flr (lr)?

Without any child involved no chance of success in article 8 human rights claim. A Child must spend 7 years in the UK as well.

Any further application will be refused automatically unless u clear 322(5) deception.

I assume that charachter and conduct requirement is for settlement and citizenship.

I also think that 322(5) is based on character and conduct.
