Embassy rules. Some embassies won't issue visa if you are not residing in the UK.mym wrote:Bizarre. Why has the EEAFP application been delayed so long? The UK has to issue it "on the basis of an accelerated procedure", the staff know that, their guidance states it.
I had the same answer from Spanish Consulate (my husband's country). That there was no way the'd issue a visa if I don't have a UK Residence stamped in passport notwithstanding that I was legally here, etc.turcaloca wrote:Yes, Directive... The deal with the embassies is that they want to see a valid UK permit on my passport before they can issue a Schengen (I understand that this may be against the EU directives but that's how they seem to "interpret" it). The clearest response I got on this issue was from the Swedish embassy in London (since my husband comes from Sweden and I travel there most often among all the Schengen states, I thought that it made sense for me to contact them first). They basically said that there is no way they will issue me a visa if I do not have a valid UK permit. I tried to convince them that I am legally resident here while my EEA2 application is being considered but they would not have any of that.
I guess the only way for me to get a Schengen visa is to travel back to Turkey (the HO is sending my passport back for travel reasons) and do the application there. Then, the issue is if I would need to apply for an EEA FP at the UK embassy in Turkey in order to be able to come back to the UK...
I honestly thought that getting married to an EU citizen would put an end to years of visa misery. How naive!
