Admin error on HO side or not ?

Admin error on HO side or not ?

Hi,

Recently extended Tier 2 leave successfully. I first got Tier 2 in March 2016 for 3 years and applied to extend it to further 3 years until Feb 2022, however, HO has granted extension for only 20 months and not full 3 years. I believe they have counted 6 years from first time I entered in UK on Tier 4. Could this be an admin error?

Tier 4 - Aug 2014 to Jan 2016 - First time entered in UK on 07/09/2014
Switched from Tier 4 to Tier 2- March 2016 to Feb 2019
Extended Tier 2- Jan 2019 to Sep 2020 (until 07/09/2020)

Recent Cos clearly stated 3 years period and same was mentioned on application form.

Have they counted period on Tier 4 visa as well towards 6 years of total stay on Tier 2 ? As it makes exact 6 years since I entered UK.

Is it worth writing to them or their discretion to grant as long as they want ?

Paid £1800 in total with 2 dependents for 3 years ( 3 years * 3 dependents * £200 = £1800), they refunded £ 900.
But how come they gave less period then requested?

I think you should write to caseworker for explanation.

Or wait for seniors advice here

Start date : 01/03/2019 ( last visa expiry date 28/02/2019)
End date: 28/02/2022

What were the dates for both of your COSs and the dates on the BRPs?

I got 6 years exactly for example, moving from Tier 4 to Tier 2 within the UK. First Tier 2 issued 24.08.16, second finishing on 24.08.22, though my second COS was until 23.08.22. I assume they gave that one extra day as they couldnt give me the full 14 days they usually do after the COS end date as that would take me beyond 6 years.

1st Cos
Start Date : 15/02/2016 End Date: 14/02/2019

1st BRP
Start Date: 13/03/2016 End Date: 28/02/2019

2nd Cos
Start Date: 01/03/2019 End Date: 28/02/2022

2nd BRP
Start Date: 29/01/2019 End Date: 07/09/2020

Seems really strange to me. Waiting for seniors to comment so I'll take this up with HO.

Yes that seems like an error, you are eligible to be on Tier 2 until 13/03/2022.

Write to them, there's no harm in asking.

OR

Should this be a 'reconsideration request' ? ( https://www.gov.uk/visa-and-immigration ... n-requests)

Considering the fact that I have not received a decision letter and only BRP so don't know which option to choose ?

Hi,
1)Pls contact the BRP delivery team whose response is within-1Day[Both Email/Calls],then follow up them they will give the Right contacts for u move next Direction.
If u are NOT Ok with BRP,you should log complaint with BRP team within 10/15Days I suppose.
Your case was bit tricky.It looks UKVI{AR}& decision is from HO?
