Which visa should my wife apply for?

Post by iamthesams » Tue Feb 12, 2019 5:45 pm

Hi,

I recently got my ILR through LR and would like to know which visa should my wife apply to continue staying here.

Profile:
a. First entry to UK in Jan 2015. Visa: Tier 1 (entrepreneur) Partner
b. Switched to PBS dependent (Tier 2) in Jan 2018 - Visa valid until Feb 2021

She has been in the UK for 4 years as my spouse and dependent.

Now that I have got my ILR, the questions I have are:
1. Can she apply for ILR too?
2. If cannot apply for ILR, Which visa should she apply for? (Can you provide the form name please?)
3. Is there a time limit for her to change her visa?
4. How soon can she be eligible for ILR?
5. can she keep her current visa (PBS dependent) which is valid until Feb 2021 in spite of me changing from T2 to ILR and use it to travel until expiry?
5. Will this affect her ILR eligible years?

Many thanks.

1. No.

2. FLR M spouse visa. She needs to meet the English and financial requirements.

3. No but she must apply before her current visa expires and if she has plans to travel out of the UK she should apply before travelling.

4. 2025 long residence ILR if she meets the requirements or 5 years on FLR M visa

5. She should not travel, risky as she could be refused entry and her visa cancelled as you got ILR based on long residence and not pbs route.

6. ILR based on 5 years yes. ILR based on long residence no.

Thank you very much CR001! Really appreciate your straight to the point answers!

One final question, is there any deadline by which my wife should apply for FLR M after I get my ILR? (like 21 days from my date of ILR)

Thanks!

I got my ILR on 7th Feb 2018 through Long residence. Thank you!

No.
Her current PBS dependent visa is valid until 2021.
The sooner she applies though, the sooner the new ILR clock can start and if she needs to travel, she can.

p.s. please keep ALL questions on the same application in ONE topic. All topics merged now.
