Hello everyone

DO YOU KNOW GOOD SOLICITOR(from London) WHO HAS EXPERIENCE AND KNOWLEDGE OF THE ISSUES ABOUT NON-EU FAMILY CASES.

We used EEA1 and EEA2 form, but not answer. It will be one year in July since no answer from them. My partner sent many years ago asylum seeker application, where no answer.

We need professional help :!:

Hi

He is from Iran, he has been here for 8 years and his application for asylum seekers is still on without the answer. Actually, first was rejected, then he made fresh one. We married in zoroastrian centre (religious wedding), which according to HO was not accepted.
However, they keep his EEA2 form and they has said that it is in consideraton, because we are unmarried couple and he has not valid stay here.

we talked to two solicitors, but both say somethin else. therefore, we dont know what to do. EU and Solvit is not able to help, because he came here before. MP looks like she doesnt know too. Not sure if anyone knows here.

There are a number of issues with this application. He is not a family member, so the Home Office will decide based on the circumstances. And he was in the UK before without status, so he cannot really claim the right of free movement.

If you want to guarantee success, you should get married in one of your home country. Then he can apply for an EEA family permit from your home country. He only needs a tourist visa to satisfy legal stay. It will take a few weeks and some traveling, but there is little that could go wrong.

Of course you can also wait for the outcome of the application, but it could take a long time.

And just make sure: you are not from one of the ascension states?

Hi

I am from Czech Republic, but not sure what ascension state means.

So in that case, he should withdraw his application for asylum seeker and go back home?
But problem is we had zoroastrian marriage(HO has our papers) and if we go back to Iran and get married we are going to have muslim marriage (no others possible in Iran) and he claimed his second asylum seeker on the base that he converted to Zoroastrianism. Therefore changing religions all the time would be suspicious, dont you think? and it may influence negatively our non-family member application to EU.

Not sure if he can travel to Czech and we can get married there. And how long he would have to stay and wait for dicision?
