Tier 2 Dependent / PBS Dependent Health Surcharge

Hey Everyone,

I need some help regarding PBS Tier 2 Dependent visa.

Currently applying for my wife tier 2 extension. I moved to ILR last year and it expires in 2024. My wife's visa expires on 25th Feb 2019, she is eligible for ILR in April 2022.

My Questions are:

1- When I go to the part where I have to pay ihs, shall i write my visa expiry date as Feb 2022 as it brings the IHS down to 1200 pounds. If i write my official ilr expiry date it comes to 2400 pounds?

2- Is there a way for her to get her next visa till April 2022? I moved to ILR from Tier 2 (upto 3 years) route - can I apply for over 3 years for her?

1. Yes fine to do that.

2. No. The immigration rules state that a PBS dependent will get a 3 year extension once the main pbs migrant has ILR or BC.

What was the initial visa issue date of your wife's visa?

Hi CR001,

The initial visa issue date for my wife is 21 April 2017. But since my Tier 2 was expiring on 25 Feb 2019 she got the visa till 25 Feb 2019.

The problem is that when I apply for extension now she will get another 3 years which will take her to 4 years 10 months and then I will have to apply again for 6 months so that she is eligible for ILR. Is there a way I can avoid that?

No, unfortunately not.

You should apply using the existing postal route to try buy the couple of extra weeks for a decision to be made and hopefully that will mean her visa will be valid up to within 28 days before the 5th anniversary of the initial visa issue date.

I'm not aware of this postal route. The only way I know is where you submit the application online and then post the relevant documents to UKVI through post. Is there another way?

Also to buy me some extra time can I submit the online application on the last day and then send the documents to UKVI?

That is the postal route.

You could do that yes. Keep proof of posting though.

Again back to gaining some time, if I delay the Biometric Enrolment and use the full 3 weeks length to get the biometric done will it push the starting/expiry date on the new visa further?
