2013-2016: Tier 2 Employer-sponsored Work Visa (3 years)

2018-2023: EEA RC (valid for 5 years, replacing lost card above) - (effective 3 years 2016 - 2019)
In theory I should have been given Pre-settled status immediately, as I have had a RC card for 3 years and we attached my application to my partner, but this hasn't happened. Wonder why. I thought the HO would have all info they need?
Or... I'm thinking they don't know what to do with me, because the app decided to submit me as Settled status (I have NI records since I started working, so, since 2013, circa 7 years), yet I only have 3 years on the EEA RC (in theory qualifying me only for pre-Settled status).
Anyone in a similar position (non-EU family member, holder of biometric RC) has had any confirmation of status, or know how long this takes after their EU family member has had theirs?

It is a bit annoying, but... there is absolutely no urgency.
I'm still having some hope that if it's taking so long it's because it's not a straightforward Pre-settled case, and that I could be granted Settled status (although that is not what the experience of other cases tells us).
Just thinking how silly it is that they have simply not thought this through with clear guidelines to deal with non-EU with over 5 years in different visas, as to have to escalate our cases. It's clearly a trend, I know of at least 5 people who have waited substantially more than most applications, and its always that same profile.

So she selected pre settle status I have selected settled status as I am here since 2011 they could not locate my hmrc record automatically so I had to provide my bank statement as resident evidence and marriage certificate as a approval of relationship! I have applied with my RC (Not PR) which issued in December 2015.. I am afraid I will get pre settle status too????? I have got my COA straight away.

I have the impression your choice of words is misleading. based on your RC history, yes, you should be granted Pre-Settled status, just as I should be granted Pre-Settled status (over 9 years in UK but only 3 on RC), whether we like this or not, and regardless of what he hope for, unfortunatelythey could not locate my hmrc record automatically so I had to provide my bank statement as resident evidence and marriage certificate as a approval of relationship! Are you talking from experience? When I applied on January 21st at no point did it let me choose, it just informed me the application would be submitted for Settled Status.

Well if you read our posts you would know non-EU with over 5 years in UK are waiting on average between 3 weeks and two months.Let see what their answer would be? It’s been third day I am waiting for.. anyone in same situation?
Not at all. it's still very early. Give them a week and if you still hear nothing, then call them.
