Tier2 ICT Established Staff to 10 year ILR

Hi

I came to UK in 2010 on following visas-

1. Business Visa - May 2010 to June 2010
2. Tier 2 ICT Established staff- 2 Sep 2010 till Aug 2021(intial Visa for 3 years followed by two extension of 3 and 5 years respectively) within UK.

There is no continuous 180 days and no total 540 days, away from UK during above mentioned Visa duration(starting from May/June 2010)

As per 10 year ILR route, am I eligible for ILR on Apr 2020(28 days before completing 10 years in UK)?

My spouse and kid (6 months when she came to UK) came to UK on 2 dec 2010 (although t2 ict establishes staff dependant visa was issued on sep 2010) and have Visa till Aug 2021(same as me). They too do not have continuous 180 and total 540 days away from Uk.

Is my wife and kid too can apply for ILR under 10 years route along with me on Apr2020, or do they need to wait till Nov 2020?

If I get ILR under 10 year route on apr 2020 and family can’t apply along with me , then for period of 7 months (apr to nov 2020) does my wife and kid need to switch Visa to some dependent Visa ? If so, which Visa category and can this switch happen within UK?

Long residence doesn't allow dependents to apply with you. The must wait till within 28 days of the 10th anniversary of the date they entered the UK.

No need to change visas once you get ILR unless they have plans to travel out of the UK.

I arrived on business Visa on 4 th may and then went back on 15th June 2010. Then on 2 sep 2010 I came back on t2 established staff long term, which is valid till aug 2021.

There is no plan for my family to travel outside uk between apr 2020 to Nov 2020( date in which they will be eligible for their 10 years ILR). In this case I can switch my Visa to ilr, and they can stay on Tier2 ict long term dependant between apr to nov 2020?

In my case, as I came on business trip on 4 th may 2010, i can apply for ILR mid apr 2020?

Assume business trip is also considered for 10 year continuous stay?

All visas count for ILR long residence which is counted from date of entry to the UK.

Hi There

Appreciate your expertise advise on the following matter.

I came to the UK on a C-Visit-Business visa on 27th June 2010. I then left the UK on 11th September 2010 and came back to uk on 10th October 2010 obtaining a Tier 2 ICT visa (Visa was stamped 23rd Septmber 2010). Since then I have been extending my Tier 2 ICT visa in country (Whilst living and working in uk) with same sponsor. The visa is currently Valid until Novmeber 2023. I travel out of the country often due to the nature of my job but I haven't ever been out of the country for over 180days in any one go. Nor have I exceeded 540days as a total away from the uk since I came to uk (Not even close).

1) Pls help confirm I will be eligible to Apply for ILR in 2020
2) If so can apply 28days prior to 27th June 2020 or 28days prior to 10th October 2020
