Applying for ILR after compliance visit from Home Office

Post by milsha1110 » Wed Dec 12, 2018 12:33 am

Hello Friends,
Apologies if this has been asked before .. but I do need some guidance.
I will be completing 5 years on a Tier 2 visa in Feb 2019 ... and wanted to apply for ILR in or after mid january.
At the end of October ... there was a compliance visit from the Home Office . As per our experience .. the visit went well and we have provided all the necessary documents that were asked off us.
I would like to know a few things:
i. What are the turnaround times for the Home Office to respond to the Sponsor? is it that if the audit is cleared then the Home Office responds within a month or else it takes a long time to respond (eg. after 8-10 or more) weeks ?

ii. While I am awaiting the results of the Home Office audit , can I apply for an ILR ? And will the ILR be rejected on the grounds that the audit results for the sponsor are not yet available?
Need some advise on this asap.
Thank You
Milan

Why do you feel you have to wait for the HO to decide?
If the sponsor’s licence is subsisting on the date you apply..go ahead with the application.
Besides that what other option do you have?

@Aman
Homeoffice guidance clearly states that if the inmigrant has applied for ILR whilst a decision is pending for the home visit, inmigrant’s application will be put on hold.

@Milsa you would be better off finding and switching to a new sponsor. It may not be an easy thing to do but try that. Or alternatively wait for hone office decision and hopefully it would be a positive decision.

Our decision came with in one monty but i was the only one on the sponsorship. That is why it was a quick decision i think.

ILR -Set (O) application with employer change -documents to submit

Post by milsha1110 » Fri Mar 01, 2019 2:52 pm

Hi moderators and members,
I am applying for ILR via the 5 year route (Set(O)) .
My employment history is given below:
Employer 1 - from Feb 2014 to Dec 2017
Not employed in January 2018
Employer 2 - from Feb 2018 till date.
Completed 5 years on Tier 2 in Feb 2019.
I have a couple of questions :
i. As I have switched employers , do I need to submit any documentation pertaining to my previous employment ? If so what are these documents?
ii. As my previous employer declared bankruptcy ... they have not provided me with a P45 document. Do I need to show this document to the HO?
ii. is the gap in January 2019 considered within the continuous period of employment ? Will this have a negative impact on the ILR application.

Would be grateful to get some good advice on the above .
Thank you
