Tier 2 - Marrying a Swiss National in the UK

Post by Still_Unmarried » Mon Mar 04, 2019 10:31 am

Hi All,

I have been on the forum for a while and there seems to be a great wealth of information here.

However, my case seems to be one that required creation of a new thread (pardon me if something similar does exist as I have failed to find it).

I am on a tier 2 work visa currently living in the UK, my girlfriend is a Swiss national living in Geneva. I am aware that I can get married to her on a tier 2 visa in the UK but I am not entirely sure of the process.

I had two questions:
1) Is religious marriage alone acceptable?
2) If i wear to go to the marriage registrar office. Will I need her to come with me and complete an interview and then wait on the certificate/letter first before being able to get clearance to marry? Will i need we need to show any documents?

What confuses me is that she is a swiss national and not a British Citizen, is the process going to be radically different for us to get married in the UK? if not, then I may already have the answers.

Many thanks to anyone who can guide me a bit.

Regards,

fredddyfred

Hello,

Dont know if my information will help you or not.
I was having a similar situation as you, trying to get married on a tier 2 visa with a non EEA citizen( Brazilian ).
I got the answer saying that, if we were to get married here, she will need a visa, which requires the prove of relationship. And also you'll have to provide some other very hard-to-get documents, in short words, yes its much more complicated to get married here.
So it will be better to get married somewhere else which will be relatively easier than getting married in the UK. In your case for example, get married in Switzerland.
Once you get married outside the UK, just use the marry certificate and apply for spouse visa.
I dont think religious marriage will count as you wont get a certificate, but it can be a part of the proof of the relationship, which you will need when you apply for spouse visa.

The OP is in the UK on a Tier 2 visa. Once married, the application would be for a PBS Dependant visa, not a Spouse Settlement visa.
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

The UK and Swiss have their own Free Movement agreement, but probably subject to Brexit.
