Set O - Evidence of your absence from the UK and Crown Dependencies

Post by Justo » Sun Mar 03, 2019 10:10 pm

Hi all, I am filling out the form and after providing destinations and dates of absences, I see the following question:

Evidence of your absence from the UK and Crown Dependencies
What evidence will you provide to support the reasons for all absences from the UK and Crown Dependencies? (Required)
You can select more than one option.

If I am not breaching 180 days rule, do I need to provide evidences of my leave? There were around 50 short trips across 5 years, so this may be very hard to collate all the supporting information. Thanks

Thanks. I am well within 180 days limit, so it is not an issue. Do I need to provide evidence in this case?
Other than work trip there were bunch of holiday trips too. How do I support those?

Thanks a lot for your response CR001,
Can you help me undersigning why I only need employment letters? Question in the form also mention letters from traveling agencies, so possibly I need to provide air tickets or letter about my paid leave as well? - I just want to find some official guidance to be sure. Thanks

The immigration rules and guidance state that only employer letters are required and your passports with stamps.

Great thanks, so only business trips have to be supported, even if they are within 180 days. For personal travel, no support is required.

All absences from the UK need to be stated as they all count towards the 180 days limit.

my employer did not provide me the letter confirming all the absences, as they do not have records before 2016.
however they have confirmed my annual leave entitlement on the employer letter and stated that i was in continuous employment throughout my qualifying period.

as per guideline
:Interim caseworker action – missing evidence
If an applicant is required to provide specified documents from their employer explaining their absences and fails to do this, and the absences do not exceed 30 working days plus statutory public holidays per annum (for example, such absences are likely to be consistent with paid annual leave), you can choose, having regard to all the circumstances of the case, to consider the application without this documentation.
You still need evidence where the absences in a 12 month period (as defined above) exceed 30 working days plus statutory public holidays.

i hope this should be sufficient

Set O - Dependents applying separately

Post by Justo » Mon Mar 04, 2019 10:10 pm

I looked through search but was not able to find a quick answer.

Me and dependents are eligible to apply from April. I am applying super premium and dependents normal route.

1. When I fill the application only, do I need to complete dependents details same time as mine? Or, do they need to fill out separate online forms as they're going standard route?

2. Can we all submit application on the same date, or do dependents have to wait until I get my ILR?

Thank a lot!

1. Separate forms if applying separately.

2. Likely after your ILR if applying separately. They will only qualify for ILR if applying with you on one form, or after you get ILR.

Hi ,
did you get letter from employer for conferences or workshops you attended outside of UK?
I had 3 conference trips in two years, about 15 days in total when I was working for my Ex employer which is difficult to get letter for them.
Is is ok to apply without those letters? as they are less than 30 days

Thanks
