Strange flr m acknowledgement letter

Post by ihameed30 » Fri Mar 08, 2019 9:39 am

I applied for my wife flr m 1st extension. She is in uk since 2007. Got 2 kids. Now the acknowledgement letter says that application will be decided in 8 weeks and contains rest standard stuff.

But last paragraph says "your application raises issues relating to the eurpean convention on human rights which are complex in nature. It falls outside our normal service standards for deciding leave to remain. Please be assured that we will make decision on your case as quickly as possible.

Please guide what this means?????

Is this standard letter or not....

It is a standard generic letter. Many applicants get it for various types of visas. It simply means her application will likely take longer to decide than 8 weeks.

If she has been here since 2007, why hasn't she applied for ILR based on long residence?

What is her full UK immigration history?

I will apply for her ILR in 2019 sept as her continues residence was broken in spet 2009 as we applied a week after her leave expired.

Does this issue if European convention thing is with everyone. I mean every one gets this letter or its just us..... Any idea why wud they send this letter to us.. She has not got any immigration history problems at all....

Thanks thats understood by the contents of letter as well.

But what i am trying to understand is that if there was a delay why they have included this European convention thing as a reason for delay. They could have just said the application will take longer.

Does it mean that they might have refused the flr m extension and are now deciding the application on european grounds?????

I am not sure what you are not understanding in my response that it is a GENERIC STANDARD reply and means the application will likely take longer the 8 weeks, thats it, nothing more.

You are reading too much into 'eurpoean' and overthinking.

No worries. Thanks for this. Just confused as y wud it take more than 8 weeks as it is a very straightforward application.

I will try to remain calm and not over think.

Her continuous residence hasn't been broken because in 2009 there was a rule which exempted the period of 28 days overstaying.

Does anyone know if that paragraph in the acknowledgement letter means that homeoffice will put my wife on flr fp route rather than flr m route which she had applied extension for??

How can i be assure that i have submitted a correct as both the forms are completely similar with no difference.

Can i write to them saying it is FLRM extension i intend to apply and not flr fp.

This is so confusing. No where on the form it says that if it is a flr m oe flr fp.. All it says is family route.

How can i get this on a correct path. Plz guide.

ALL. TODAY i have recieved the 30 months extension visa for my wife on 5 years route.

That paragraph on the acknowledgement letter is totalllyyy confusing my wifes application did not take more than 8 weeks. Actually a week less then 8 weeks. And that European convention thing was a total wrong print on the letter....

This just make people soooo much confused..... Anyway thanks to all who helped... Especial cr001
