What is the correct date to apply Ilr in 5 year route.......?

Hi


I joined in a company when I am on PSW. Then company sponsored me for Tier 2. I just wanted to know which from which date do I need to calculate 4yrs 11 months. Please let me know.

Joining Date: 25-08-2014
Cos Issued Date : 03-09-2014
visa application date : 04-09-2014
visa issued and Start date on Biometric card: 21-10-2014

1). Some where I lost my employer letter which is issued in September, 2014. Should I have it must or If i produce P60 from HMRC is that enough.

2). I last application received and confirmation letter from UKBA which they sent me in September, 2014.

3). Now I changed my employer and I can meet salary criteria for ILR , I am planning to apply in August or September 2019 which ever is near.

Please let me know the eligible date for my ILR application.

You start counting from visa issue date, so 21 October. You can apply no sooner than within 28 days before 21 October 2019.

2. Not required.

3. Fine.

Holiday letter from Previous Employer

Hi,

My Tier 2 visa granted in September 2014 and in August 2019 I will be eligible for ILR in 5 years route.
current my salary will meet ILR threshold criteria

I went to India (My home country) on annual holidays, dates are
21-10-2015 to 05-11-2016 (16 days approximately)
21-12-2015 to 05-01-2016((15 days approximately)
17-04-2016 to 01-05-2016 (16 days approximately)
18-11-2017 to 03-12-2017 (16 days approximately)

Now I changed my employer recently, but I have not taken any letter from my previous employer stating that I was on annual holiday during my trip to India.
1). Does it effect on my ILR application decision in August 2019 ....?

Your previous posts you stated your Tier 2 visa was GRANTED/ISSUED on 21st October 2014. Why do you believe you qualify for ILR in August??? You were already advised that your ILR clock starts from date visa is granted and NOT from the date you submitted your application in September 2014.

21st Oct 2019 minus 28 days. The date of application is the date you pay and submit online. Biometrics date is irrelevant so make sure you do not submit earlier than you qualify.

Tier 2 - ILR (sac salary caliculations)

I was granted my Tier 2 on 21 October 2014. I am planning to apply for ILR in the first week of October.

My employment letter says

Soc code:2135.
working Hours : 40
Anual Salary: 36000.


Could you please give me clarification on this as per the rules my salary is matching with ILR criteria or not.

I am just confused that ILR salary criteria 35,800 is for 39 or 40 hours. Please let me know thanks.

The prescribed salary levels are based on a 39-hour working week. Converting your salary on a pro-rated basis to 39 hours a week will yield an annual income of £35,100 which is lower than the current threshold for ILR

Thanks for the reply.

Every year December I have annual increment. My Salary will be increased 3 to 5 Percentage. It will reflect on January pay slip in between 37000 to 37800 Pa.


Does it mach ILR salary criteria for me ??

You need to be paid at least £36730 while working 40 hours per week which is equal to an annual salary of £35,800 based on 39 hours per week
