Tier 2 General Visa Process after CoS

Post by rafi_aamiri78692 » Mon Mar 18, 2019 12:06 pm

Hello,

I am currently working in UK with ICT Tier-2 Dependent visa and my company has offered sponsorship and I received my CoS.

Please help me with following clarifications

- I have been working with the company for 8 months and now they have sponsored CoS in this situation do I need to be re-hired by the company for changing the visa from ICT Dependent to Tier-2 General Visa

- Do I need to go to my home country (India) to apply for visa or can this be done from UK

- What are the documents do I need to prepare

Kindly advise

Regards,
Mohammed

No. But the full and proper RLMT must have been done to prove you have not been 'pre-selected'.
- Do I need to go to my home country (India) to apply for visa or can this be done from UK
You must apply from home country.
- What are the documents do I need to prepare
The online form and the guidance notes tell you what is required.

The cos needs to be withdrawn and reissued. Likely through HO monthly allocation again.

Maybe you don't need to be tested?
https://www.gov.uk/tb-test-visa

Who does not need to be tested
You will not need a TB test if any of the following apply:
you’re a diplomat accredited to the UK
you’re a returning UK resident and have not been away for more than 2 years
you lived for at least 6 months in a country where TB screening is not required by the UK, and you’ve been away from that country for no more than 6 months

You cannot apply for the visa within the UK. You have to apply from your home country.

Yes, HO can still question it or ask for details after Cos is issued.

No idea, I don't work for ho. But HO has in the past asked for cvs and candidate details of applicants and reason why they were not successful and you were.

As you were already working for your employer prior to being Sponsored under Tier 2 expect an enhanced check prior to your visa decision.

There is always a greater level of suspicion where existing employees switch from another immigration route to tier 2.

Has the Sponsor issued you wily just a restricted COS? If it is not a restricted COS then you can’t use that COS to apply from Back home. Please get the COS verified as a restricted COS or you will be wasting your time going home.

As per previous post - your Sponsor should have applied for a restricted COS. In doing so, they will have had to provide the RLMT information when they applied for the restricted COS. So you should get your employer to provide you with a COS print out.

Fine. Note also that you are not 'switching', but applying for a new entry clearance visa. Switch refers to changing visas within the UK.
