When to apply for ILR

Post by a.zaheer » Tue Mar 26, 2019 11:51 am

Hi

I want to apply for my wife's ILR however want to ask when is she eligible based on following:

1. She got her initial entry clearance visa as dependent of Tier 1 General in December 2013 and arrived in UK 09th April 2014.

2. I got my ILR in June 2014 (based on Tier 1 General 5 years route) and we applied for her FLR(M) in june 2014 (Postal application), for which she was granted leave to remain in September 2014.

3. We applied for her further leave to remain (after 2.5 years) and she was granted leave to remain as FLR(M) till Nov 2019.

My question is when is she eligible for her ILR? Does her time as dependent of Tier1 General counts towards 5 years or not.

Any help will highly be appreciated.

Thanks all

My question is when is she eligible for her ILR?

No sooner than within 28 days before the 5th anniversary of her FLR(M) visa issue date in September 2014.
Does her time as dependent of Tier1 General counts towards 5 years or not.
No it does not.

You appear to have applied for ILR based on 5 years Tier 1 general. There was no reason to switch your wife's visa to FLR(M) in 2014, she could have continue as a Tier 1 Dependents until she qualified for ILR

Thank you the reply. The reason we switched back then (from T1G dependent to FLR M) was the difference between T1 G dependent fee vs FLR M visa fee. We are happy to wait for another few months :) Thanks for the advice
