Tier 1 Entrepreneur to ILR - Pre April 2014

Hi,

I applied Tier 1 Entrepreneur in April 2013. Received visa 28th April 2014.
Applied for extension 28th April 2017, and received extension visa 6th June 2017.

I had 3 part time employees from my previous grant of leave. 1 left, 2 still working as full time. another new employee joined august 2017 as full time.
so currently 3 full time worker.

My question is :
Can I show my previous extension application employees during ILR applicaion or do I need to create additional 2 full time job ?

During my extension i followed pre april 2014 rules, I showed 3 part time worker and calculated total hours of work to make it equivalent of 2 full time job, is it the same rule for my ILR application as well as ?

You simply need equivalent of 24 months of employment AFTER extension granted

Yes but as I advised, you should ONLY count the employment periods AFTER your extension was approved (after June 2017)

Tier 1 Entrepreneur Dependent ILR Question

TO : Zimba88; Your help would be appreciated.

First Tier 1 Entrepreneur visa : April 2014 with 2 dependant (wife and a daughter).
Tier 1 Entrepreneur visa Extension : June 2017 with 2 dependant (wife and a daughter).

April 2019 I am eligible to apply for ILR.
1. Can my wife and daughter also apply for ILR though they would be in Tier 1 Entrepreneur dependant visa for 5 years ?
2. Wife first applied to enter to the UK as a partner of Tier 1 PSW, before 9 July 2012, Do I need to meet the financial requirement ?
Partner - £18,600
2 children in addition to partner - £24,800 [ 2nd baby born in September 2017, after visa extension]

"d) You must meet the financial requirement
You need to meet the financial requirement if you are making your first application for leave to
enter or remain here as a partner, or did so on or after 9 July 2012, or if your last leave was
granted as a partner of a Relevant Points Based system migrant and you are now applying under

2. There is no financial requirement for PBS Dependents.

I will follow exact same I did for Tier 1 Entrepreneur extension.

ILR:

Me, dependant (Wife and Kids) can fill up SET(O) form, as we all will be 5 years at the time of ILR application ?

Some one listed tons of Cohabitation Documents on another post, is it really required ?
Wife came to the UK as PSW dependent in February 2012,
Applied Tier 1 together and finishing 5 years together. We have 2 kids.

Confusing to me !!!

You need to submit two years of cohabitation documents only using 3 acceptable documents

There is no standard definition, but some examples are bank statements, council tax bills, mortgage/lease documents etc. In general, any official documents.
They don't have to be joint but have to show both of you have the same address.

I filled up form SET (O) online, at the end of application it lists mandatory and other documents that we need to submit.One of the documents says -
"Employee Payment Records, original HM Revenue & Customs P45 or P46".
It seems a bit confusing to me, what did they mean actually ?

Also, Once I fill up, submit, and book an appointment to www.soprasteria.com, visit them, scan and upload documents, do I still need to send all these documents by post ?

1) It is showing in the checklist because you ticked it while you answered the specific question while filling the form. You need to check box only what is relevant to you. This is not required.
2) If you chose new service, this is all what is required as you stated above. You don't have to post documents. Your original documents will be verified at UKVCAS centre at your appointment.

As I am pre-april 2014 applicant, and I employed 3 settle workers, last 2 years have enough hours, should I really submit all of their working hours, or just required working hours, 2 full time equivalent or little bit more, does it really help if we submit extra hours ?

Also my accountant lost 4 RTI-FPS because of server crashed, it was in middle of a year, shall I just avoid those payslips, RTI-FPS or how would I mention it? If I ignore those payslips and RTI-FPS, it doesn't effect my 2 full time equivalent working hours.

Do they accept any cover letter any more ?

You need 24 months/104 weeks FT employment (minimum 30 hours/week) after extension. Relevant RTI-FPS. Must apply before 6th April 2019 to rely on transitional arrangements. If the employee worked 32 hours it would be 32 why would you mention 30 🙄🥴

Once I tried to untick box - "Employee Payment Records, original HM Revenue & Customs P45 or P46", it shows me following message:

tick all the boxes to agree that you will provide these documents

this is strange. When I untick the box, it allowed me to do so. that was a couple of weeks ago.

I spoke to Home Office, I have been asked to fill up that form again, I did it and it works, thanks a lot for your kind help.
