Claining Universal Credit while wife on spouse visa

Post by legalkhan » Tue Apr 02, 2019 12:51 pm

Dear Forum members and Moderators,
I have been jobless for the last 2 months, been looking for one. My question is if I being a british citizen apply for Universal credit until I get a job, will this claim gonna effect my wife future extension?? I don't want to claim her element of the Universal credit but still I have to provide all her information in the application. How to make sure, this claim doesn't effect my wife's visa. I will be really thankful if some one respond to my query.

UC is a joint benefits claim because your wife's wages are used to in the benefit calculation and work requirments. We don't know how this will affect her visa.

"If you have Limited Leave to Remain or Enter you usually have no recourse to public funds. This means that you cannot claim most benefits, or have someone else's benefit claim increased to cover you. If a claim is made it may affect your right to remain in the UK.

You should seek specialist advice before going any further if you, your partner or child have Limited Leave to Enter or Remain."

If you were working in the relevant two previous tax years, you can claim New Style JSA; this used to be called Contribution Based JSA. Like the old (legacy) benefit, this would be claimed in your name only because it is based on your contributions only, but you must not take extra JSA for your wife because she is subject to immigration control. Your wife's wages would not be used in this benefit calulation and neither would any capital. Limited to a maximum of 6 months and you still need to attend the job centre.

I should add that if you left your job, or did something to lose your job, there will likely be a Sanction of 3 months before you can claim jobseekers.

Be aware that you will be required to prove that you are looking for work for at least 35 hours a week, one of the things required to avoid another Sanction, which can then be for up to 3 years.

Thanks for such a valuable information.
