Can I stay in Jersey island during T2 ICT cooling period ?

Post by smb2015 » Fri Apr 05, 2019 8:45 am

Hello,

My Tier 2 ICT Long Term visa will be expiring after few months and as per current condition there isn't much option to get it extended so I will have to leave UK to serve the cooling period of 1 year.
My has an office in Jersey island, so I wanted to know if it is possible to move to Jersey for an year, serve the cooling period there and then reapply for ICT visa for UK. I read about jersey and came to know it is not part of UK https://en.wikipedia.org/wiki/Jersey
However, I'm not sure how the immigration rules are between the two and if it is allowed to be in Jersey for the T2 ICT cooling off period.

Looking at the work permit rules for the island - looks like a though process to get a visa.

Would it qualify for cooling off period - I believe it does.

I had a discussion with colleagues on the island. There is little or no chance that you will be granted a visa. Apparently your company has to state that the work you would be doing is exclusively for the purposes of the business activity on the island and that there is virtually zero possibility of anyone else in the UK / EEA that can do the role. Assuming you are in a service or IT role.

They do not have many work permit visa holders outside of the hospitality or health sectors.

Does you current Sponsor have a work permit licence for the island?

Yes, my Sponsor have work permit licence.
You mentioned "There is little or no chance that you will be granted a visa ..." , is this because getting visa is tough or because I already have completed 5 years on T2 ICT in UK ?
