Just a quick update on ahmad vs sec of state matter.

This is now challenged and matter is in the court of appeal. There are other several other refusal cases based on 39e and 276b(v) linked to it aswell.
He is seeking permission for hearing. It might take atleast 5 months from now to get an update on this case.
Hi Sunny

Has Ahmed been granted permission yet or he is still waiting for permission. and wen u said several other refusal cases based 39e and 276b v linked to it as well. wat it means? will they all be heard on the same day in CoA?

Hi sunny,

Thanks for your quick reply. They asked few questions and said it’s done for today. It was ok.

Regarding the JR. I have sent PAP to office and it’s been a week since I sent and my lawyer gave HO two weeks to reply.

Let’s see what happens.

This thread is now moving away from its original OP post. This is not a place to discuss your individual cases. As per case law, the judgment given to Ahmed will be the standard applied to all similar cases unless it is successfully challenged which is quite unlikely :!:

Hi Sunny,

Thanks for asking. My situation is, I came into this country on 14/07/2008. I was first refused just 1 month and 21 days before I reach my 10 years. Hence, I did set (O) application in 14 days and varied to set(LR) once I reached 10 years.

My first refusal is the outcome of my FLR(FP) application which was in 23/05/2018

Now, they refused as my 3c was broke on 23/05/2018.

But my lawyer is saying instead of arguing the Ahmed case find your uniqueness and fight for that.

Hi Khan881

can we discuss on here?

i have made application now so i dont think i can change this.

also Home office should know about this rule so they should not refused. incase if they do i will go fight for it.

i am hoping for the best.

Thank you.
Hi Shah_143,
If HO knew it is RIGHT thy r NOT entitled to refuse their OWN defined Laws&Rules.
It is Like giving u Driving License& stopping u to Drive?

So, is this NOT outrageous w. r. t HO deceiving Applicants legal rights to work, it is expected to give Applicantion Rights till Refusal/ Decision been received by Applicant with 14-days deadline.
Till End of 39E, Applicant is entitled to apply application(s).
How can a Self-Governing ,Law-Governing responsible Organization commit-such mistakes &play with Millions of LIVES by NOT free service but by charging very huge Application £3000 FEES???....!

Also how can "tier-1/2 be refused & there needs to be additional un-necessary turmoil to such applicants to go-through all stages of Appeal in court,PAP/PIP,JR-,court visits Barrister Fees & finally WIN over HO for NO mistakes from Applicants&NO-Compensation being payed to Applicants from HO after HO loosing the cases!!!
Why PEOPLE are NOT asking for all of this & HO just gives &accepts it's mistakes & NEVER fined &penalized for its ACTS/convictions of outrages/False/Deceitful/Dis-Honest decisions!
HO-is loosing 72% of it's refusal cases by statistics till DATE which are being turned over in COURTS.

NOT every applicant is prepared to visit courts &waste 12-46+ Months of LIFE for silly 6-29 Months of HO visa. Many have just Left UK because they can NOT afford to waste that 46 Months of Appeal/JR-Life moving around courts like DOGS with NO Income/work Rights& Barrister Fees?
If every Applicant is Given Rights to Appeal in UK,with NO Fee service& Govt-Payed Barristers ,it would increase to 90-95% of HO Refusals will be over-TURNED in the courts.
It is common sense that Shah/Khan" has to be given his ILR lawfully. Why does this case needs a BARRISTER for such a straight forward CRIME from HO.And HO NEVER pays for All the costs incurred by Applicant during the process of JR/Case dealings in courts the tumoil their families faced?
Is BBC dead?
Good Luck Guys!
