FLR FP APPEAL GIVEN

Hi I have been following this forum for quiet a while & need the suggestions ASAP
My immigration history

Came to uk on student visa (sep 2011 till May 2014 )
College revokes jan 2012
Havntt recieved any letter
Admission new college (jan 2013 )
Applied premium Croydon (jan 2013 )
Refused with right of appeal (Same day )
Lodged appeal on papers (After 10 days )
Appeal allowed April 2013
Reconsideration May 2013
Visa granted till April 2014
Applied extension March 2014
Granted jan 2015 till April 2017
June 2015 college revoked
Met my partner Oct 2015
Leave curtailed May 2016
Applied flr (o) May 2016 (fed up education system )
Refused jan 2017 with no right of appeal
Applied fresh application flr fp jan 2017 (unmarried partners ) ` useless soliciter ‘
Went to register in March 2017
April 2017 got permission to marry
May 2017 got married
Sent pictures & marriage certificate (May 2017 )
Jan 2018 recieved is96
Feb 2018 refused with out of country appeal (clearly unfounded )
Applied pap (jr ) March 2018
March 2018 (detained at singing )
Released on bail after 1 week
Filled jr April 2018

May 2018 changed soliciter
Applied fresh flr fp married (refugee partner ) May 2018
June 2018 biometrics
July 2018 jr refused (judge says certified but can go & Apple entry clearance )
November 2018 wife been diagnosed with eplypcy (minor brain 🧠 Tumor (first stage )
Dec 2018 sent all documents to home office as exception circumstances
Feb 2019 recieved a letter from ho to briefly explain the diagnosis of disease
Feb 2019 sent 3 letters (gp neurologist hospital summary sayings she’s not fit to fly & had test pending
Doctors stating can be cancer or infection or tb )
Feb 2019 refused with right of appeal
(Refusal letter says relationship is gunieune we can make arrangements for her to go back & live there or u can go there & alley for entry clearance )

As explained to them that my wife’s just 21 yrs old she’s working part time & earns less & she’s the only sole child of pension mum dad she can’t leave them & I can’t leave her coz of her illness
She can have fit anytime of day & night )

March 2019 appeal lodged
April 2019 appeal Hearing (Hatton cross (dame place I got bail )
Paid fees to soliciter & barrister preparing the bundle
They says the case is 60-40
As u have some exceptional circumstances in ur case
Let’s hope for the best

Preparation (bundles )
Gp letters saying not fit to fly
Neurologist letter not fit to fly
Discharge summary not fit to fly
Gp explaining can be cancer or infection
Got follow up test on late April 2019
Got neurologist appointment dec 2019
My statement
Wife’s statement
Father in law statement
Mother in law statement
A letter explaining problem if she relocated in India as she’s refugee
She’s never been to India


So I would like to ask all the moderators & people who r reading to give their best suggestion wat do we need to bring with us to the courts & wat r the chances of my success
Do I need to go India for entry Clearance ???
In there refusal letter
They have accepted every single thing for flr fo except that I overstayed & no exceptional circumstances

But home office site clearly says that a serious illness could lead upto exceptional circumstance

Hope for the best

My case and your case is exactly similar.
Did your barrister give them in reference any case laws such is chikwamba etc.but I hope it will allowed this time.your immigration history not too bad and if you p submitted in time applications so 39e will apply on you .

My case history same as you but my wife is born British mean.
Now I am waiting for the home office decision hopefully this month I will hear some thing

Came here in 2011 June student
Applied tier 4 extension in March 2014
Tier 4 granted to January 2016
But college revoked and my tier 4 visa curtailed in December and got 60 days in that 60 days I tried to get admission in university but that time wasn’t admission session so went for flr and it’s refused in March 2015 i had appeal right then all appeal right exhausted
In 2017 April
Submitted fresh application and we married in August 2017
Application refused in December 2017 but I was doing reporting but they gave me refusel on 6th of March.we sent another application as married partner but we were gathering more proof and solicitor didn’t send mairrage certificate and the refused my application in two days without biomatrics and acknowledgement and without right of appeal. .i was detained on 20th of March and they were trying to put me in charter to deport me at same day I claim asylum and my removal differed.
We went for JR and they released me on the 28th of March and told me to go for screening interview which I did and later asked me for main interview for asylum but we wrote to them I want withdraw my asylum my JR is pending.they refused asylum and letter sending me again asylum letters.mt JR refused we sent another application but completed proof also with English text and wife 18600 wage slips.
They send me couple of weeks ago another letter for as
Asylum interview.and my case worker sent a letter my flr fp application letter said your asylum is pending and we can’t consider simultaneously both if you want withdraw the asylum sign the form which I did or if you want withdraw your flr fp application write to us but I sent asylum withdrawal.
Now don’t know what will happen
