Tier 2 ILR 5 years term short by 29 days

Post by Dshetty » Thu Jan 10, 2019 8:39 pm

Hello,

My query is to know whether I can apply for ILR application on 5 years route on 02 May 2019 via tier 2 visa route ? What date will I be eligible?
I was looking to do a in person appointment.

Details about the case is as below:

I have recently noticed that I was not granted full 5 years tier 2 visa until 01 July 2019 instead it's was granted until 02 June 2019 (4 years 11 months 1day).

Hence I wanted to know whether I can apply ILR on 5 year route in person or is it better to apply via post ? Am I eligible to apply 28 days prior even though I wasn't granted full 5 years tier 2 visa..

I am running short of exactly 29 days for 5 years.

Visa type: Tier 2 General (5 years with no extension )

Visa validity : 01 July 2014 to 02 June 2019.

I have checked my COS start date and it has 02 June 2014 as start date and the end date is 02 June 2019.

Historical leave to remain visas were
Tier 1 Post study
Tier 4 Student

An advice/thoughts is appreciated.

Thanks very much for taking time to review my query.

There is no longer an in person same day decision service.

You cannot apply any earlier than within 28 days before the 5th anniversary of your visa issue date, so 28 days before 1st July 2019.

Hi,

I got the same issue as well as 5 years is not granted fully. Bit annoying though. Is that means do we need to do one more year extension before applying for ILR?

Thanks a lot

@CR001 thanks for your input.

If I apply 28 days before 1st July 2019 i.e. 03/06/2019, I would not have a valid visa to apply.
My tier 2 general visa is valid only until 01/06.2019. i.e short of 2 days

What are my options in this case?

Thanks again for your time looking into my query.

I am in same boat, its all so confusing.

Some people say post your application, but I am not even able to find the form required, or we can apply online and then download application and send it to UKBA

Hi,
May be apply for Tier2/Studend/Dependent visa before Visa expiry & vary it later once ur 5yrs crossed.
This is that simple!
Ask others gurus for details.
GoodLuck
