Spouse visa to ILR: Extensive time away

Dear all
Been a long standing member of this amazing forum and I am glad to find it still thriving and helping people with their obstacles.

I had a question related to my wife's ILR application, due in May 2019. I have read the previous topic here, but I just wanted to double check. Basically, she has been away from the country for extensive periods on 2 separate occasions- maternity leave and helping my family during my dad's chemotherapy.

Important points:
  • She first arrived in the country on Spouse of settled person visa in Feb 2014
  • She had her extension granted (leave to remain) on Nov-2016 which expires on May-2019
  • The maternal leave was BEFORE the previous extension. Since the maternal period, we have had the extension granted without any problem (we provided all the relevant documents)
Here is the complete breakdown of absences:

With the recent changes related to absences by Home office, can I check if you think there will be a problem? I will of course be providing all the relevant documents but am concerned with conflicting information regarding the "Continuous period" or residency.

What 'recent changes by HO' are you referring to??

THANKS FOR AN INSTANT REPLY!
I know there have been changes related to how the absence period is calculated (Y-oY rolling as opposed to 12month period from day of application). It may not be relevant to my application at all as I dont see the Spouse visa listed on guidance list! So apologies if I am only being paranoid.

Absence limits aren't relevant under the Spouse Settlement category.

Once again, I am relying on this amazing forum to help me out. I think I have got all the basis covered but wanted some comfort as the money I am paying for this application makes me want to cry :x !!!

My wife is applying for ILR through 5yr Spouse visa route (SETM). Arrived in the country in Feb 2014. She has been away from the country for child delivery and supporting my father through chemo. I copy paste the portion of her cover letter to list all the documents I have included.

PS. I dont mean to scare other applicants! I know I have probably put in a lot more than they had asked for, but didnt want anything to be left to chance with the money involved:

1. Proof of identity and application
• My Indian passport
• My Biometric card
• My husband’s British passport
• Original Marriage Certificate
• My husband’s signed declaration

2. Educational
• NARIC letter for both BA and MA qualifications
• Original BA certificate from Osmania University
• Original MA degree from Osmania University (India)

3. LIUK Pass notification letter

4. Financial requirement
• My husband’s payslips for the 12month period: March 2018 to March 2019
• My husband’s bank statements showing the salary paid in
• P60s for the years 2016, 2017 and 2018
• Company letter detailing the employment status.

5. Life events
• Original Birth certificate of my son

6. Residence in the UK
a. Cohabitation documents for last 2.5years
Joint name:
 Tenancy Agreement : Current tenancy agreement signed in Jan 2017
 Letter confirming let from letting agents: Apr 2019
 Council Tax bill : 2016-2017, 2017-2018, 2018-2019, 2019-2020

Can I also check if the entire passport needs to be scanned an uploaded? I have only uploaded the main page scan copy of my and wife's passport. I am submitting both the originals anyway, so thought that wouldnt be needed?

NARIC letter for both BA and MA qualifications You only need ONE degree. Is it English and comparable Naric assessed (costs £150)?? >> Yes, NARIC letters stating its comparable to British Masters degree standard.

My question was if NARIC did the ELA and the comparable assessment, i.e. not just comparable. You need both assessments and your post is not clear.

My question was if NARIC did the ELA and the comparable assessment, i.e. not just comparable. You need both assessments and your post is not clear.

There is
  • Acedemic qualification statement stating degree is comparable to British masters
    English proficieny Statement stating level of English is CEFR Level C1
I had used the same for the previous extension.
