I am on Tier-1 Entrepreneur Visa 50K route and I have a query regarding Job Creation post my Tier-1 Ent. visa extension on 19 Sept 2017.
Tier-1 Initial Visa Received: 21 March 2014
Tier-1 Ent. Extension Applied: 18 March 2017
Tier-1 Ent. Extension Received: 19 Sept 2017
Tier-1 Ent. Extension Visa Expiry: 19 Sept 2019
Since September 2017, I have created jobs to complete my requirement for ILR. The employees Job Timeline is as below.
Employee-1: (Admin Manager) - Continuous Employment since Feb 2016 but since my visa extension came in Sept 2017, I am counting the job employment for ILR from Oct 2017.
From July 2018 to March 2019, my employee went on Pregnancy leave during which she was paid pregnancy pay as per HMRC rules.
She resumed normal work from April 2019.
So:
Can I claim this as continuous employment from October 2017 until April 2019 including the pregnancy period (Jul 18 to Mar 19)? Because I did not terminate the employee contract and it’s still on-going?
OR
Should I claim above employee's employment from Oct 2017 to June 2018 (9 months) + April 2019 to June 2019 (3 months) = 12 months? Not including the pregnancy period (July 18 to Mar 19) ??
Employee-2: Sept 2017 to May 2018 (how can I use this?)
Employee-3: Jan 2018 to Aug 2018 (Marketing Manager) – Left Job in Aug 2018
Employee-4: Oct 2018 until on-going (Marketing Manager) – Hired new person for same role.
There is a one month gap between Employee-3 & Employee-4 but Total employment time for same role is 16 months so far between 2 people including 1 month gap. The job role and its JD are same. Can I use this as 12 months continuous employment?
And last Question is it ok to have the hourly rate be slightly different between 2 people on same job role? In case of Employee-3 & Employee-4 (Same Role).
Will HO will only consider the fact that both employees are above National Minimun wage and working 30 hrs per week?
Please advise if I qualify for ILR based on 2 jobs creation for 12 months each. Thanks
