Voluntarily elected to leave question...

Post by lainybug » Wed May 01, 2019 10:01 pm

Please could someone clarify how to answer these questions:

1. Have you ever been deported, removed or otherwise required to leave the UK?

2. Have you ever voluntarily elected to depart the UK?

The situation is that the person had a dependent visa. The marriage broke down so they let the home office know. The HO curtailed their visa, and the person left the UK prior to the new visa expiry date, using their own means.

Many thanks for your help with this!

Neither of above applies as long as the person left within curtailment deadline.

I would answer No to the first question and Yes to the second question in that case.

I believe "leaving the country before the curtailed visa expires" is "choosing to voluntarily depart the UK".

Say no to both because 2nd question refers to those who got option from HO to either leave voluntarily or they will deport them.

Voluntary departure is the wording used when a removal notice has been servered to an overstayer. The overstayer then chooses to leave under there own steam rather than being arrested / detained etc.
Leaving while subject to a curtailment notice is not overstaying.

The answer to both questions is no

One more question please...

Have you ever travelled to the UK in the last 10 years...Please enter details of your 5 most recent visits.

If the person had a dependent visa from 2016 to 2018 and travelled to the EU a couple of times for short periods for holidays...I assume they need to list each return date for each holiday? What would you pit as "purpose of the trip"? Returning resident?

Thank you!

Thank you for the fast reply.

The purpose of her travel to the UK wasn't a holiday though - she was already resident in the UK and returning after a holiday elsewhere?

Returning resident means if someone holding ILR is returning to UK after more than 2 years. In my view just state honestly the purpose of stay and it won't affect anything.
