Got it - so in this case, since we married in the UK after he arrived in the country, the date on the marriage certificate takes precedence over the date he arrived in the UK, and would be when the counter starts for me for the 5 years continuous residence. Thanks a lot!CR001 wrote: ↑Fri Apr 26, 2019 6:47 amYour time under the eea rules starts counting from when your eu spouse arrived in the UK and started excersing treaty rights.
Your time before spouse arrived in the uk doesn't count. Note this applies if you were already married when they arrived. If you married sometime after they arrived, it starts counting from date of marriage if married in the uk.
Hi gini852,gini852 wrote: ↑Thu May 02, 2019 7:04 amSmall update: I did call a third time and they confirmed the last answer they gave (ie. in my case, it's from the date that my spouse arrived in the UK, which is sometime before we got married because I was already in the UK and we were already in a relationship at the time of his arrival)
Hi, I have called the EU settlement team on a weekly basis, sometimes twice a week for the past two months.askmeplz82 wrote: ↑Wed May 08, 2019 12:36 amPlease ask EU settlement team. They will be able to give you right answer

Believe me, I have called them a lot and like you, I am always getting different answers.gini852 wrote: ↑Wed May 08, 2019 7:39 amHi Mats,
Based on the answers the Home Office has given me so far, if you apply for the scheme here your clock should have started from the time you both arrived in the UK about 4 years ago - so if you're accepted for pre-settled status you should be only a year or so away from getting settled status. But if I were you I'd call them directly and check as well. Hope that helps.
Hi Gini852,gini852 wrote: ↑Sat May 11, 2019 8:44 amHi Mats, my EU spouse just heard back from the Home Office re: his application. As expected, they gave him pre-settled status BUT the letter stated the status starts from the date of the letter - this comes a bit of a surprise considering he's been in the UK for a year and we'd given them proof for that. So if his pre-settled status starts from now then I think it would affect the non-EU spouse's application since their pre-settled status can't possibly start any earlier. I think your spouse would run a great risk in applying for the scheme because it could well restart his clock, based on how they're treating the EU citizen applications, never mind the non-EU ones like your spouse/myself.
