Can my wife apply for ILR?

Post by ExpertUser2019 » Thu May 16, 2019 1:03 pm

HI All

I recently had my ILR in April 2019, my wife currently on Tier 2 General dependent visa and spent 3.5 years in the UK and currently living with me.

Can she apply for ILR based on https://www.gov.uk/settle-in-the-uk/y/y ... ier-5-visa without spending 5 years ?

Thanks in advance

On what basis did you get ILR, tier 2 or 10 years long residence?

She needs 5 years residence. Why do think she might qualify now?

On what basis does the solicitor say that she doesn't have to wait 5 years?? Why would your spouse be exempt from the 5 year residence requirement for ILR??

That advice is very incorrect and I hope you didn't pay for the advice only to be given false information.

The link you have posted clearly states she needs 5 years residence.
