Partner and her kids coming to uk to live and marry.

Hi there.i wonder if anyone has some advice for me.my partner and her kids are from Belgium and are moving over in 8 weeks to live and then we are going to be married the following month.we have been together over 18months and know each other for years.we have a rented house to live in in both our names and the kids have schools set up.we have a uk joint account also.she plans to start work as soon as she comes over.we are going to apply for a uk marriage visa but we are unsure of what we should do before hand.we have had to wait to see what brexit did but we want to make sure they can stay here for the rest of our lives.hope to hear from someone soon.

They were born in Belgium and live there at the moment and are eu citizens.they have Belgium identity cards that they have used to come over.

Then no need to apply for a visa. If the are EU citizens, they can just come over.

So we wouldn’t of needed to apply for the fiancé visa.can we apply for the uk marriage visa when we are all here?.she is wanting to start work before we are married and how long could they stay without a visa?.they will all be looking to stay here for the rest of their lives with me.its all very confusing at times.

EU citizens do NOT require a visa to enter or live in the UK or to get married!! Note they must be EU citizens and not non-EU citizens with an EU/Belgium residence card.

Once here they can apply for the EU pre settled status.

Thank you for all your advice.its a big move for us and we just want it right.i will look into the pre settled status to see what we need to do.theres a lot of scary stories out there.

Sorry to sound silly,but if they get pre settled status does that mean we won’t need to apply for a visa at all?

I just wanted to clarify that a visa is not needed for their entire lives they arè here.that we don't have to apply for a visa 6 months after they arrive.

Nobody can give guarantees like that for 'their entire lives'. Immigration rules change. Brexit could change things considerably, depending on how that will go down in the end.

If the goal is to live in the UK for their entire lives, keep up to date with changes over the next few years and get naturalisation applications started as soon as they are eligible.

Then after 5 years usually they apply for Settled status, which is PR.

That’s is what we are going to do.we are going to apply for British nationalism after five years.its just that we needed to know we would be safe when we had pre settled status up to the 5 years

If you are married yes, once your partner has settled status (which has to be applied for after 5 years), then they can apply for citizenship. If you are not married, they have to wait 12 months on settled status before applying for citizenship.

Note that your partner and her children have to apply for pre settled and settled status.

We are getting married in August and are applying for settled status knowing its pre settled status we will get in july after we have registered at Drs,got a joint bank account and moved into our new home.she is already on the council tax bill for our new house and all the utility bills.we are coming over by ferry as we bringing all the furniture over.we are buying ferry tickets to show we have entered the on country on that date.the kids have schools already set up to go to also.

Then yes, once she has Settled status after 5 years (i.e. PR), then she can apply for citizenship immediately if she meets all the requirements.

You should also have plan B too instead blindly relying on recent/previous position of European citizen & their family members rights in UK. Because if not in August 2019 but more likely by the end of October 2019 the UK might leave Europe although with few transitional measures but again in next 5 years of times such transitional measures might not in place.

Does that mean that on the 31st of October if it's no deal that everyone with pre settled or settled status will have it taken away and have to do something else?we are getting married in August and have schools and we has everything ready to apply for the married visa.

Its not yet fully clear as how will it benefit/affect but at least those who already acquired settlement through completing 5 years route or those who are very near to complete 5 years won't be affected. But in next 5 years there should definitely be a lot changes because UK won't be dependant on any European court & their rules.

It's relatively unlikely but other visa categories have been axed pretty abruptly before, so there is never a complete guarantee.

In case this actually happens, you could sponsor them under UK rules but this is all a bit academic. Under current rules, EU nationals do not need a visa. They can apply for pre-settled status and subsequently for settled status and naturalisation.

Anything else is speculation and nobody has a crystal ball.

An update.we have a back up plan but when we apply for the settlement scheme we will have in both our names a council tax bill,utility bill,ticket to show they entered the country on the 6th of july,a joint uk bank account plus Drs appointments attended.will this be enough to get pre settled status?.my partner is applying for a national insurance number as soon as she is in the UK so she can work as soon as possible.
