Did you send any documents EEA national sponsor ? If yes like ID / residency proof ?
My NI was used for proof of my residency, i sent copy of ex EU ID which expires in 2022, marriage cert and i also contacted council and they sent me a letter to say myself and my ex were liable for council tax in 3 different addresses for a 6 year period. The letter clearly stated the addresses we both lived in and her name was on this letter as well.

Has your divorce proceedings started??
My Ex Wife told me she send already . I'm waiting for divorce letter from the HM Court . But I think it doesn't matter under EU settlement you still need to send residency proof for your and your ex wife last 5 years ..

Anyone here on EU settlement Scheme refused so far ? I heard few people waiting for more then 4 months. Their application still under consideration. According to Government website Home Office trying it's best to have less refusal by the way many applicant now withdrawing their application .

I just had a look at inspection report for the period Nov 2018 up to Jan 2019. The key points:
1. HO had to employ new staff to deal with Settlement Scheme applications forms. By the way that explains why the applicants are given different information every time when they contact Resolution Centre. Staff are just unexperienced.

2. HO wonder why so many people (especially EU citizens) applied for permanent residence prior applying for Settlement Scheme.

3. Good news: staff's morale is "to grant, not to refuse". Until there is some serious criminal element about the applicant.

Hi! any update so far? I have nothing, just a reply from the resolution centre saying that they will investigate my case further... same answer I had 2 weeks ago when they escalated my case for the first time... it seems that they really don't know what to say.... I feel our rights are not being treated accordingly , at least if we could get an honest answer, that would be better

Still waiting nothing apart still under process
On website come out new guidance about application etc for caseworker yea
And say u can apply with brp card
And them will contact you atleast 3 times
In my wife case say we should apply paper form application and them will contact with me to fix it
But when ?

Then wait 70 days and apply again using paper form

sorry it's says in the caseworker guidance / eu settlement scheme applicant information pack that DUAL NATIONAL ( BRITISH ) can't apply online. your application is invalid. you will be wasting time waiting. rather withdraw now and reapply after 70 days..

Sorry I’m dual citizenship Polish and British and my wife applied as family member of eeu and and we applied them say online is fine
But now looks like we should use paper application etc

Hi all I am about to submit my application for pre-settled status, as a Non eea family member who was married for 3yrs and 5 months, got separated separated about a month ago and currently going through the process of divorce. I have got a residence card from the previous(pre-eu settlement scheme ) process confirming my rights (not retained as of today as divorce just started)already. Haven seen different posts about applying for the settled/pre-settled status even before decree absolute gets issued, I called the eu settlement scheme resolution centre to check the possibility of this and was told it is okay to apply. I'm however still skeptical and would like to know if anyone actually have been able to retain their rights via the scheme despite waiting on divorce proceedings finalisation. and if so, what documentation were submitted as part of the application.

What are you waiting for??? YOU MADE A MISTAKE INITIALLY BY APPLYING ONLINE INSTEAD OF REQUESTING PAPER APPLICATION. As a result your application is voided. It's your interest to contact them and request the paper without withdrawing the application. Do not wait untill HO reject your application as invalid. Basically "voiding" means annulation, to be invalid.

It's your interest to contact them and request the paper without withdrawing the application. Do not wait untill HO reject your application as invalid. Basically "voiding" means annulation, to be invalid.

Them say caseworker will contact my wife regarding this
And gave her application I’m calling them every same day it not easy them just saying everything is ok
Just wait for instructions
Even me ask if application is valid then say it is
So I don’t know 🤷‍♂️

Have a look at this thread:

The person like you applied online, was waiting for nothing, contacted HO and was advised to apply through the paper application. Do not listen to the resolution centre: they are not people who involve in a decision making, they just provide generic information. Call resolution centre and ask to transfer you to someone who is responsible for the applications with dual citizenship and request the paper application.

It take them so long almost 6 weeks and nothing since some guidance come out and now we can do it order paper application put number our wife application

You are welcome. Yes, just print out the application with the reference number and attach to the covering letter where you should briefly explain them your situation. Due to the high volume of applications I think HO start looking at them after few weeks after people applied. I recently called RC as I could not log in my account at all. Was advised that the sysmem is down (technical issue), everything is fine and my application is in a queue.

Quick update
My wife applied for paper application any way lady say she going to send it .
After one hr other lady called from different department and ask my wife few questions/ address
Etc . She say someone will call within two weeks and have some question regarding this later if decide to we need paper application them going to send it
Seriously lost now . What them will decide after when call

Na still waiting .. I am not calling them anymore
. I saw few people waited 2 month . I called them on 11th May “ your application is alright . We have all information we need . Caseworker doing some check with other government agencies “

Yes in the cover letter . I told them because I couldn’t give proof of my Eu sponsor residency for 5 years . I have joint bank account still with her but I told them I will send it if they require

But how do you send a cover letter? Was that done as an update email? as there is no space to fit that in with the application. could you shed more light on this and how you drafted it.

I converted word into PDF and uploaded documents online . marriage certificate / expired RC / cover letter / Eu sponsor letter from HMRC

You can do that too . They allow you to upload 10
Documents . I did not have to upload residency proof for myself because system already said I am
Eligible for settled status ( automatic check when you include insurance number )
