10 years LONG Residence ILR visa

Post by Mani8 » Tue May 28, 2019 5:44 pm

Hello All,
Hope you guys can help me. I came in UK 21st Sep 2009 in student then in 2016 change to work permit. I got visa till Sep 2019. There is 10 days less to complete 10 years long residency visa. However, I was told from the friend I am eligible to apply before 28days visa expire and i have my husband and 5 year child in my dependent visa.

My question is do I need to apply my child ILR visa along with me or can I apply citizenship directly after I got my ILR. Note: my child have biometric now and the visa expiring as mine. Some of my friend said no need to apply ILR it will be waste of money. I can apply my child citizenship directly once I got my ILR. Really confuse
Please need a advice.
Thanks
Mani

Long residence ILR does not permit dependents to apply with you. Only you can apply on the form.

Your UK born child can be registered as British on form MN1 once your ILR is granted.

Your spouse will have to switch to FLR(M) spouse visa and meet the English and financial requirements. Their 5 year clock for ILR will be reset to zero, 2 x 2.5 year visas. Visa fee is £1033 and IHS is £1000.

I am planning to apply my husband his ILR as well because he also come when I came in UK. He will also complete his 10 years along with me and he have English test and life in uk.

So can I apply my daughter citizenship after I granted ILR? even though she have her visa expiring on 30th Sep 2019??

1. Your husband has to apply on his own separate form and meet all the requirements himself.

2. Yes.

Lastly, which form do I need to fill for 10 years ILR??
Form Set(LR). It is an online form and you each have to your own separate form etc.
By any chance do you know what are the supporting requirements document??
Passports for the whole 10 years, including the passport you entered the UK on.
English B1 or UK degree or foreign degree with NARIC ELA and comparable assessment.

You will get a checklist of documents at the end of the online process.

Do both of you meet the absence limits??

No she won't be. You can also apply for ILR using the super priority service.

That is the only way you can do it. You need your ILR BRP for her citizenship application.

The rules allow you to apply within 28 days of your 10 anniversary of the date you entered.

There is nothing in the rules that state you MUST have a valid visa up to this point or past this point. Many have been successful in this scenario.

There is no '1 day in person same day decision' service anymore. You would have to apply using UKCVSA Super Priority service, which costs an extra £800 and there is no guarantee you will get a decision within 24 hours.

Remember that the date of application is the date you submit and pay online and NOT your UKCVAS appointment date. So make sure that you only submit and pay once you are within the 28 days period.
