Appeal approved but no response from Embassy

Post by man1976 » Fri Jun 27, 2008 11:36 am

Hi,
I would like to enquire how much time ISB Embassy takes after the appeal has been approved. Our appeal was approved by AIT on the 6th of March 08. (dependant parents over 65). We are still waiting and have not heard anything from the Islamabad Embassy. Any one have idea of how long it takes ?

I also had an appeal approved in April. I was told by the customer service team that firstly the HO had 8 working days or within which to appeal against the decision, if they did not then they had between 6 - 8 weeks to inform the embassy that the visa be granted. We are still waiting to hear from the BC.

I'd advise you to call the customer service team at AIT (Have your appeal ref. number handy).

This is the email address you should send reminders to after an appeal hearing.not the main email address of ISB BHC, otherwise you get automated response.

BHCAppeals.Islamabad@fco.gov.uk

The Home Office have 28 days not 8 days to appeal against the AIT decision. If they do not appeal the HO will send notification to the BHC by post to issue visa if the ECO is satisfied. This can take upto 2 months, as I have reliably been told they make some discreet enquiries prior to issuing visa to ensure nothing has changed.

So in total it can take upto 3 months.Keep pestering them with emails saying the unnecessary wait is creating stress for you and that you want the matter to be resolved asap

There is an error in my earlier message. The Home Office have 5 days and not 28 as stated by me.

Here is an extract from Entry Clearance Guide issued to ECO's

27.10 - Appeal Determinations
The Tribunal should promulgate its determination within 10 days of the hearing or as soon as practicable. All allowed determinations are sent to Angel Square where the Specialist Appeals Team (SAT) formally Onward Rights of Appeal Team (ORAT), have 5 days in which to decide, after reading the determination, whether or not an error in law has been made.

I emailed appeals.islamabad regarding the appeal and they replied me back asking for passport numbers.

I emailed them back the passport numbers and its 1 month since i emailed them the passport numbers.

Now they havent replied me back and i am wondering if there is another way to accelerate this.

Can anyone advise me if its worth talking to my local MP and asking him for help

Regards
manman

Yes i Iwould urge you to contact your MP and explain the sittuation to him, and ask him to write direct to the BHC Islamabad asking for latest position.

Alternatively ask the MP to ask the appropiate misister in the HO in London to look into it. Remember what the BHC has on its computer is easily accesible by officials from HO in London.

I have a sneaky feeling they have cocked it up. A friend of mine was recently refused EC, but was later asked to bring his passport to have his vias stamped.
