how long does tribunal take? my wife can't be in the UK when our son is not! it is a bit crazy

Sorry to hear about this. Any update?

Take a Legal DNA Paternity test. They will have your child go to their DNA center where your wife and child is located and you can take one at a DNA center where you are located. They will ship both dna to their lab for testing which will only take 2-3 days and then they will mail you a legal certified document which shows the paternity results.

Then have your MP send it to the home office.

Best of luck and hopefully you get this resolved. My daughter was born on March 2018 and I had my parent of a British child visa refused in September 2018. I now have all of the correct evidence and will be reapplying. Will send out my application this month.

Update:

In the past 2 month, we have transferred my wife's visa to a future date hoping somehow my son's visa will come at the same time or probably have to transfer again........

We've taken the DNA test and given it to our solicitor which they have sent to the home office already.

We've also been given a date to submit our evidence because UKVI told tribunal that their previous decision to overturn was a mistake.

Anyone knows how long does it take to get the visa after submitting the evidence? In our case the only reason UKVI has now to reject us if they aren't sure we are related however we have the DNA result which shows I am my son's father with a probability of 99.999%!

p.s.don't know why they don't just list DNA test on the appendix, not accusing anyone but it seems this process is designed to make it as difficult and tricky it can to apply for a visa.

This is just ridiculous. You have provided the birth certificate which is a legal document to prove the relationship. On what basis they doubt this?

I am applying Family visas for my wife and my children as well and I received "Not straightforward" email recently. My wife and older child were stayed with me in the UK for 2 year with dependent visa. Only the new born child has never been to the UK. I don't know which part of the application is "Not straightforward" as all criteria are fulfilled.

Hope your case will be sorted out soon and hope I could have some good news.

Update: yesterday we asked our MP to call UKVI to get an update after posting DNA test result in. Just now we received an email saying my son's appeal has been withdrawn and we will probably see visa granted.

This time I'm holding my tears back until I actually see my son's visa and both of them in the UK with me.

Because we had to transfer my wife's visa to 15th of August due to my son's visa being refused, now we actually hope they give us the passport back in August so we don't have to transfer the visa again.

08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

He real passed through long road.
Has the HO got such free reign or are there times when the courts makes them pay for the discomfort caused to applicants? Any recorded cases of such?
