Made redundant but starting grievance procedure

Post by kontakenty » Sun Jun 02, 2019 8:43 pm

Hi all,
I am currently on a Tier 2 visa, and my employer has made me redundant and bullied me to the extent of pushing me to severe depression and anxiety which ended in attempting to end my life a couple of weeks ago. I was rescued and taken to hospital, and signed off from work for 3 weeks now for depression and anxiety. My last day of employment is 5th of June. I am considering starting grievance procedure and possibly suing my employer as I have all the medical records proving that they were the cause of all my mental health deterioration.
My question is, if I start the grievance procedure, will they still inform the home office of my last day of work (5th of June), or are they legally obliged to wait until a verdict is reached after the grievance hearing or possibly the court hearing if I take them to court? Thanks.

They are legally obliged to tell the Home Office that they terminated your employment no more than 10 days after your contracted last day. So time in lieu of redundancy of say a month would move the date to 5th July as an example.

Your grievance procedure is an internal matter with your employer and has no bearing on your employment status. You can carry on with your grievance assuming your company policy allows it post termination.

Even taking your employer to Employment Tribunal will not stop the visa curtailment process.
