Overstaying query

Hi All,

Currently I hold ILR and will be applying fo BC soon.
I came to the UK on a business visa in 2013 and applied for tier 2 visa and of course my application was rejected, i received the decision after my business visa expired. I contacted the HO and provided my flight details so they can organise for passport collection from the airport, i left the country within 10 days.

Could you please advise me if this will affect my BC application?

your query is unclear. You have not informed on what visa you are now residing in the UK to apply for BC.
Time you have lived in the UK etc etc.

Thanks for replying.

When i overstayed, i was on business visa
After that i applied for tier 2 and was granted
Now I'm on ILR after i completed 5 years on tier 2 visa.

I hope it's not going to be an issue

What dates weas your business visa valid for?

How long were you in the UK, exact dates?

What date did you poly for tier and what date was it refused, and reason for refusal?

What date exactly did you leave the UK?

Hi,
Thanks for your response. Details are below

Business visa valid from 24/05/2013 to 24/11/2013
Entered the UK 15/06/2013
Made tier 2 application on 25/10/2013
Refusal letter dated on 26/11/2013 received on 29/11/2013
The reason of of refusal: not allowed to switch from business visa to tier 2, the application should have been made outside the UK.

UKBA Plymouth documentation contacted me by email on 3/12/2013 informing me that they received my passport, i was told to allow 1 week to make my flight arrangements.
I left the country on 07/12/2013
Made tier 2 application from my home country, entry clearance was granted on 18/12/2013.

Please let me know if you require further information.

Hi Waelayoub,

I am not an expert but from the timeline you listed above, it seems you’ve done everything right and on time. If I were in your shoes, I would make sure to include this detailed timeline in a cover letter to HO when you apply. You met your deadlines you should be fine. But again, please seek a different opinion as I am not an expert.
