Caught up in process - what would you do if you were me?

Caught up in process - what would you do if you were me?

Hello all!

Have found this forum very insightful and was wondering if anyone can help give advice based on my situation:

I am a non-EU national married to an EEA national. We both live and work in the UK (I'm on a Tier 2 visa). Last month, I applied for pre-settled status via the EU settlement scheme but have since found out via the scheme's hotline that a "known technical problem" arose on Sopa Steria's side that has affected my application. This is apparently known to only affect some applications and there is "no known timeline" for this technical problem to be resolved. In short, they can't tell when they can properly process my application.

I was also told via the scheme's hotline that they could not withdraw my application as the biometrics have been done. But I don't want to be at the mercy of something so vague and indefinite so I'm considering applying for the Residence Card. My question is: is that even possible? Can I, whilst this application is technically still underway, apply for a Residence Card? I know it'as only valid until December 2020 at best, but at least I'd have something rather than the Tier 2 visa.

Does anyone have any insights on this?

You can apply one after another .. plenty of people applied PR AND SETTLED STATUS at the same time too
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021
