UK settlement visa for a child

UK settlement visa for a child

Hello all,

Please assist us.

We are applying for a UK settlement visa for our child aged 7. I am married to my husband who is a British citizen and I have a child from a previous relationship (never married the child’s biological father). My husband and I and my child live together in UAE. We all have been to the UK on several occasions together with my child for only visits.

Now we intend to live permanently in the UK and applying through Category A. We are familiar with the visa requirements, thank you.

We are concerned with the sole responsibility requirement for my child. Before we moved the child from Kenya to UAE, according to the UAE rules, we were required to provide a letter of no objection from his father where he mentioned my child can live in UAE or any other country with my husband and I without his further permission. Since moving the child to UAE in 2017, his father does not support or contact him in anyway till date. All decisions concerning my child since 2017 till now is taking by my husband and I including his education, hospital etc. he is solely dependent on my husband and I financially, mentally and physically as we pay his tuition fees, plus in UAE, his residence permit is under my husband’s sponsorship. We have taken him to England on 4 occasions where each time, my husband and I are named as his parents on his visas.

Are these enough to prove sole responsibility considering my child does not live in Kenya and lives with I and my husband in Dubai with no support or contact from his father since 2017?

Please help and advice us. Thank you very much

Yes please, it is mentioned on the birth certificate since he was born.

Did you submit birth certificate of your child during the initial UK visit visa application

Thank you all.

My husband was named as the father by the UKVI (I guess because in UAE my husband is listed as the father on my child’s residence permit, automatically by the UAE government even though birth certificate says otherwise) and in all our UK visit visa applications for my child, we submitted the birth certificate plus the letter of no objection as required. My husband and I were named on the visas as the visas were an accompanied minor.

Indeed, we will seek for professional advice

That's is good that you submitted the original birth certificate with the UK visit visa application. I guess they can see you weren't trying to conceal the information

Hello all,

We have been informed by my child’s school in IAE of unreasonable behaviors exhibited by my child in school. We were asked to send him to a psychologist which we did, we just found out my child was neglected and emotionally abused whilst staying with his natural father in home country. He was neglected and not given food before going to bed, he was also denied access to all goodies and clothings I send over to him during my annual visits when he was in Kenya. Now we have a psychologist report detailing the abuse and it’s effects on my child.

When we confronted the father on this, he verbally said he doesn’t want anything to with the child anymore and whatever happened was in the past and we shouldn’t contact him anymore.

Can we use the psychologist report as a compelling factor to show the ECO my child can’t stay with his natural father after this abuse and is only safe with I and husband? The natural father is suddenly ready to relinquish his parental rights over my child too.

I know you are not immigration advisers but your Inputs which I have seen on this forum has really been helpful as I have received my UK Spouse visa on priority basis in less than 10 days which I’m still surprised.
