I hold a biometric residence card in 2018 which states family member of a EU national.
However the residence card does not lead to settlement as it's under derivative rights as I am the primary carer to a EU child as my EEA spouse left and divorced me 9 years ago after living with me for 5 years in UK.
I had to appeal against the home office decision as they refused my application. The courts and tribunals decided the case in my favour as the primary carer of an EEA child in education in UK and I was issued a BRC in 2018

As you are a primary carer for an EU citizen (child)....apply online under Chen. It's faster. If you need me to put you through let me know. Hi I wanted to apply online as I hold a biometric card. however the EU resolution centre told me it has to be a paper application for chen and zombrano. They said online applications will be considered as void if applied online. I am a non EU national with a derivative right residence card under family member of an EU national as I am the primary carer to my minor 9 year old Italian child which they considered as (chen) They sent me an apication form for chen personalised for my needs. Can you please guide me on the online process if things are different or have changed

I have applied using the paper application and my application was received by HO on 14th May
I sent all proofs and have heard nothing
I have made complaints and have contacted the mp as the resolution centre has been so vague inaccurate and inconsistent with immature information each time.
I applied with my BRC card valid until 2023 under derivative rights chen as primary carer of EU child.
Would i be accepted under the scheme?
as no response from them and no COA has had me petrified.

I lived in Italy for 3 years as a family member of a EU national spouse Visa.
Moved to UK in 2008 with the EU spouse
Had a baby in 2009 in UK who was Italian by birth so got an Italian passport
My spouse left us in 2012
applied to the home office for retained rights of residence of living with EU spouse for more than 3 years.
application was refused in 2014 as spouse did not excerisce treaty rights.
I then applied as the main sole carer of an EU child
I was told to send proof of divorce.
sent in my divorce certificate with all the proofs.
Home office refused again under derivative rights in 2016
I escalated the decision to Her majesty courts
my hearing was in 2018 and the judge gave the decision in my favour as the spouse was not in contact with the child since the age of 3.
the school letters proved this as from the age of 4 to being 9 the school confirmed they have held no records of the father and it's the mother who attends all meetings and she is the main sole carer.
Home office accepted that I have a derivative right and if I was to leave the child would also leave with me and this would impact her education and she will be alienated as she is born in the UK and has never been away not even for a day.
I enrolled my biometrics in 2018 and got my card shortly after in 2018 under derivative rights for 5 years.
However I was made aware by my barrister that my BRc card under derivative rights does not lead to settlement. it's only until the child is self sufficient.
Furthermore as of 2019 the scope of the EU settlement scheme now allows deritive right chen zombrano and Teixeira cases to pay either for pre settled or settled status if they have lived in UK for 5 years.
Changes on 2nd may DOES NOT allow potential zombrano and Teixeira chen cases or derivative right cases to apply under the EU settlement scheme IF they have another way or route to live in the UK. so you will first be asked to apply for a derivative residence card and then apply for EU settlement scheme.

Zambrano carers would only be allowed under the settlement scheme in the case they have no alternative means of staying legally in the UK...in the case of Patel as they can apply for leave to remain under family route 2.5years
Chen and texteira carers how ever can and are eligible to apply under the settlement scheme if they have had residency before or not so long as it was made under the EU directives
If as a Chen carer or texteira(not sure spelled right)you have never had any leave to remain in this country more advantageous for you... I spoke with a manager at the resolution centre this morning and he breaked everything for me from their case worker guidance notes
