Evidencing Right to Work on Section 3C

Evidencing Right to Work on Section 3C

Hi all,

My partner is due to start a new job at the beginning of next month and will presumably have to evidence his right to work at least for his probationary period of the first few months. His current leave expires at the end of July. We submitted a timely application for FLR(M) last week to move from his Tier 5 YM, and he attended his biometrics appointment yesterday.

I understand that his leave will be extended under Section 3C, but how will he be able to evidence this to his new employer? Will the information be updated on https://www.gov.uk/prove-right-to-work, because so far nothing has changed?

I never seen any new employer who recruit someone who is waiting for his visa despite covered by section 3C. Mostly existing employers trust and acknowledge it.

Hi there,

Well the position was secured whilst his current visa is still valid and it doesn't expire until about 1 month after his start date. I'm assuming they will want to see right to work on his first day. When you say most existing employers 'trust and acknowledge it' - surely this must be evidenced somehow.

Seagul meant trust the right to work link to check existing employees status if they wanted to.

New employers are often more reluctant and prefer to see physical evidence of a visa.

Ok but what about temp work? I'm currently covered by section 3C and would like to do some short term temp jobs but I can't figure out how to prove I can work. Is this impossible? My BRP's expiration date was in January and that's the only physical document I have. :(
