Switching from Tier 4 to Tier 2 Dependent

Hello

I appreciate it if you could provide me an advice.

I had a tier 4 visa from Sep 2011 till Oct 2016. All my family members were living with me including my eldest son as Dependents during that period.

Then, I moved with my family to work in Dubai. In Sep 2017, my eldest son return back to the UK as Tier 4 general student. In Sep 2018, I returned back to the UK under Tier 2 visa and all other family members returned back with me as tier 2 visa dependent except my eldest son who still on his Tier 4 visa.

I wonder can I switch my eldest son's visa from tier 4 visa to tier 2 dependent as he is currently over 18. I have some evidences that might support the tier 2 dependent application such as he is living with us at the same home, the payments of the university tuition fees from my bank account, the consent letter that was during his Tier 4 visa which classifies I am going to financially supporting him during his studies.

You can switch your son's visa from inside UK

Someone told me that he can switch only if his last visa before being 18 years was a dependent visa. Is this correct?

I am a bit confused because his last dependent visa expired in Oct 2016. At that time, he was 18 years and 3 months. Later, he got a Tier 4 visa after 8 months.

So what do you think?

It does say last been granted leave as a dependent, ie his CURRENT leave to remain not a visa from 3 years ago

Thanks again.

It says: "If you are aged 18 or over, you must have, or have last been granted". My understanding for "must have" is the current. So, what's the difference between it and the "have last been granted"?

It is the same thing. The most recent leave/visa must have been granted as a PBS dependent.
