A few good questions?

Post by Lazarus » Fri Jul 04, 2008 6:16 pm

Can I ask, is it true the longer BIA keeps your file, the better chance you have of success?

Is it true it may be a bit hard t leave the UK considering your passport expire?

If your passport has expired and your country does not accept Home Office Travel documents, can they refuse you and ask you to leave?

Do you have more of a success if your MP writes to the BIA on your behalf?

What are classed as ties to the UK? eg.

To answer some of the above:-

The longer UKBA takes to resolve a case the more likely there will be additional issues which arise which have to be considered, which may weigh in favour of the applicant. But just because someone has been here for a few years doesn't mean that they can't be removed.

If someone's passport has expired they wouldn't be able to leave the UK without getting it renewed at their embassy. An airline/ferry company would deny them boarding.
If UKBA wished to remove someone whose passport has expired, depending on their nationality it might be necessary to seek a travel document from the embassy concerned. If the person refuses to cooperate he/she can be detained and even face criminal prosecution.

An MP can be helpful in getting UKBA to look at a case if they're dragging their feet, but UKBA won't change the rules just because an MP's involved. If they've reached a properly-considered and lawful decision on a case, an MP will make a difference only in the most extreme compassionate or high-profile cases.
