540 days rule

Post by Saadmlk » Wed Jun 26, 2019 10:23 pm

Hello everyone!

So I came to uk sep 2009.
Till 2014 on 3 tier4 visas.
After that 5 years on 2 spouse visas, married to a settled person.

Question is!
Does the 540 days rule applies if i am applying on 10years route to ilr? As due to some reasons cant apply on 5 years spouse route to ilr.

Any help would be very very appreciated.

Thanks.

Yes

https://www.gov.uk/long-residence/eligibility

Continuous residence is time you’ve spent in the UK without gaps.

You can leave the UK during the continuous residence for up to:

180 days at a time
540 days in total
You cannot count time spent in:

a prison, young offender institution or secure hospital
the Republic of Ireland, Isle of Man or Channel Islands
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Thanks for the reply. So I have total of 570 days out of uk. Thats 30days extra as My dad went for an open heart surgery and I had to be with him for 65 days. So will that lead to a refusal? Any ways arpund it?
Thanks

Generally yes as you cannot have more than 540 days outside the UK. Extend under the spouse route until eligible
