New residence permit for British Citizen dependants with Indian passport

Post by pradbis » Tue Jul 02, 2019 4:42 pm

Hello,

I recently naturalised as British Citizen (5 year Tier 2 General - ILR - Naturalisation route). My wife & kids have Indian passports and PBS dependent permits (their latest BRP was issued when I had ILR). They cannot apply for ILR or naturalisation yet since they have not been on a dependant (on me) visa for 5 years as yet. Their current BRPs are valid till 2021.

My question is: now that I have naturalised as a British citizen, do I need to apply for new BRPs for them? Are they still considered PBS dependants? I understand that if they have a BRP which says "Dependant of British citizen", then they would not need a Schengen visa to travel to Schengen union countries - is that true?

Any advice would be gratefully received.

Thanks,
Prad

No.

Yes.

You are mistaken. There is no BRP that says 'dependent of British citizen'. You are confusing those who are on the EEA/EU route with Residence Cards stating Family Member of EU citizen, which is not the same a spouse of British citizen VISA or PBS Dependent visa.

Thanks. This is helpful.

While on the topic - do you know if my dependants can travel to the Schengen area without a Schengen visa when they are travelling with me? I ask because somebody in a similar situation told me this is possible.
