stamp 4 in hand, what next?

Hi all,
We have received stamp 4 instead of EU1, like everyone else and we want to write a letter to the DOJ to complain about the fact that it still takes them more than 6 months to answer our request to EU1. Does anyone have a sample letter of complaint to the DOJ? That would help us a great deal.

Hi,
we applied for the EU1 (me: french; he: israeli) on November 26, he had never lived in another EU country before but we asked for residency in France before coming to Ireland. It was automatic and he received the provisional residence card for three months on the spot on November 12. Something we did on the way to support the stupid request for previous residence. We had to ask for residence in one european country to get residence in another one. :roll: yeah well....
We have provided them with all the paperwork, including my proof of employment, which they even verify by calling the HR department at work... nice!
Anyway, we received the stamp 4 letter on May 27, exactly 6 months and one day after application.
It might have helped that we stressed in every possible way that my husband is a lawyer, but I'm not sure. We have done everything by the book but still didn't get what we asked for. My understanding is that they should give us a definite answer within the 6 months on the status we applied for. Throwing us a bone to keep us quiet for one year doesn't really qualify as an answer to me.
We want to write them a letter but I'm not sure how to turn it. If anyone has a sample letter or can help us with writing it, that would be great.

They gave you Stamp 4 for 1 year, thats not good enough, i think you guys ought to write to the EU and complain.

Salut Aurelie,

a similar case is currently with the ECJ (European Court of Justice).

In the case I am referring to the initial setting is much worse, as the non-EU-partners were already illegally present in Ireland before they got married to EU-nationals, who (of course) resided legally in Ireland.

Should this case be decided in favour of the applicants, we should all be granted EU1-residency soon.

You can check the current status of things here.

Apparently the next publication due in this regard is the final ruling. Unfortunately I have no idea when this is due.

In the meantime, consider lodging a complaint with the EU about this. The more complaints the better.

Cool - thanks for that !

I asked the ECJ what happened in the above cited case.

I was told a final hearing took place on June 03rd, and the next action due is the final judgement, which will be published via the link provided.

I find their website complicated to navigate. I cannot find anything on this ominous hearing on June 03rd.

I wonder how can we get reliable non-contradictory information?

Anyone in the know?
